    Congratulations on getting a result.

It's clear that the correct procedures were not followed and Tesco, to their credit, not being able to verify that they had been, have done the decent thing and accepted your version of the story.

I'm sure that they, as well an anyone else with an IQ struggling into double figures will realise that if the video evidence had shown what security claimed to have seen, it would not have mysteriously vanished.

Although it would not stand up in a court of law, only an utter buffoon would not make the obvious inference as to who had cause the tapes to disappear.

Tesco may well have requested assistance from the police officer who viewed the tapes who would have backed up your version of events.

Given that Tesco have acted very reasonably and the fault, in this instance, seems to have been with an outside contractor, I hope you will not be boycotting them in the future.

    Thanks for your input.

    Couple of points..........

It is myself who has spoken to the Police Officer who attended as he viewed the cctv and can confirm my version of events was factual.

I had to do this as they have "lost" the cctv - otherwise as correctly stated it would just be my word against theirs - luckily an independant 3rd party (police officer) has viewed it and logged what he saw.

I have also spoke to his Sergeant who made the decision on the day that it was not going to be taken any further by the Police. He did say a lot more about the incident but at this stage I am not willing to say exactly what.

Tesco security as well as the outside security guard were all involved in NOT following correct procedures.......so yes Tesco are very much to blame.

    Codswallop.
I sure the police are interested in people using their uniformed position to make arrests and lying. It won't go down well with them.
And it was they who wasted the polices time originally-remember?

    Okay here's what has happened........

Had a phone call at lunchtime today from CEO's office.

Apologies offered - apparently it was all a "huge misunderstanding" which was dealt with very very badly (their words not mine)

My Clubcard will be returned to myself - I am not barred from the store.

The store manager is going to contact myself next week when he returns from holidays.

Re-training of all the staff involved took place last week to ensure that this never happens again.

I asked had the cctv evidence been viewed by those investigating this incident to confirm my version of events and..........wait for this...........it has gone missing and is not available !!

Just to be clear - that's BOTH lots of cctv - the one from the shopfloor and the one from the private area where I was held - BOTH not available/missing.

So full marks to Tesco for actually taking my complaint seriously enough to actually investigate it properly - and also for accepting my apologies.

To all those that said "your wasting your time and are lucky they didn't prosecute" - I believed at all points that what I did, whilst foolish, was NOT illegal - the security guy should NOT HAVE LIED to the Police and embelished his story to make me appear guilty. There was absolutely no INTENT to steal anything.

I believe that if a "vulnerable" person would have been in the same position as myself maybe elderly, learning difficulties etc then maybe they would have accepted the Police caution - on the spot fine etc just to get out of there........which I feel is not acceptable.

I will update again next week.............

    Dave.

Not the usual procedure to appear to be discouraging to you to make a subject access request .. In fact downright irregular and suspect...theyve not put it in writing I bet..

The first thing the tesco investigators would have done was viewed and I imagine either seize or copy the cctv evidence-logging this action in their books.

    Then interview the staff.

I'd definitely put in a subject access request because I think they are.. Being economical with the truth.... and how do you lose digital data..

As for retraining them-aren't they supposed to be in possession of a sia licence?
I'd retrain them all the way to the job centre..No doubt they police have said they are incompetent idiots..

What a load of old tosh!

It's up to the police to decide how they spend their time, not some bod on MSE.

Still, at least you'll get a few thanks from the 'nasty brigade'. :rotfl:

You mean when they saw you leaving the store without paying for goods? I would say no.

.. Oh dear.. Some people are poor losers aren't they ..
Is it so hard to congratulate the op for getting an apology..
    Yes, I guess it is..
Shame on you...This isn't about your ego.. It's about helping the op.

Just for the record shoplifting is no longer always an indictable offence.
The Anti Social Behaviour-Crime and Policing Act 2014 introduced an new offence of low level shoplifting for items under£200.
This crime is now dealt as a summary offence, but can also be treated as an either way offence if the defendant so elects.

Correct, but it is still classed as an indictable offence for the purposes of making a citizen's arrest in accordance with s24A PACE.

To people saying the OP stole: no dishonest intent = no theft. Plain and simple.

The difficulty for the store and the police is that nobody knows what the OP was thinking, but if what he says is right and he simply forgot about the magazine then he wasn't dishonest and didn't steal it.

Oh !!!!!! - try reading the thread.
There was no intent ..which is critical . Stop being an Internet lawyer..

The police didn't arrest him..tescos input do not matter here
What the police say goes-end of. It's no problem.
