  • What fault is that again?

If a car is being officially recalled, are you saying there isn't a fault? Stop being so pedantic.

But first you need to have suffered a loss to be compensated for.

True. I imagine lawyers all over the World will be working on this. Whilst my car is (at present) unaffected, I'll still be trying to get my sticky little fingers on some of VW's profits.

Have you had your letter from VW yet? If you have, do you want to tell us how many times the words 'official' and 'recall' appear in it?

It doesn't say 'official recall' because the official recall was determined 2 days after I received the letter from Audi.

Only in Germany. UK gov't responded by saying it wouldn't be an official recall.

Ah ok, I didn't realise the UK government had responded to that. Whether it's an official mandatory recall or not, the fact remains that the vehicle is being recalled for repair.

They are being called in for a free repair, and in the unlikely event there were any issues with mpg or performance with your particular model, you will certainly be fully compensated, so you've no case.

I'll be closely monitoring this and unless compensation is being paid, I will attempt to use the Consumer Rights Act on the (non Audi) dealer I purchased the vehicle from.

When did you buy your car?

If it was before 1st October, then The Consumer Rights Act will not help you.

Read MSE's Consumer Rights Act news item for more information.
Here is a very short extract:
It [The Consumer Rights Act] will only apply to things bought from Thursday [1st Oct] though – the current rules will continue to apply to everything bought before then, even if the problem occurs after 1 October.

Even if you bought your vehicle after 1st October you would have no claim. That is because by the time you made your purchase you should've been aware of the issues.

Under new consumer protection laws owners of VW may be entitled to up to 100% of the purchase price back plus any consequential losses. See https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/409334/bis-14-1030-misleading-and-aggressive-selling-rights-consumer-protection-amendment-regulations-2014-guidance.pdf. It was the Citizens Advice Consumer Service that told me about this. They don't think it doesn't apply.

I think the legislation that applies to the VW scandal came into play in October 2014 not 2015.
