If other European countries do the same as Switzerland and ban VW diesel sales, VW are going to enter a whole new world of hurt.

Cannot say I have any sympathy for the company. This wasn't just a 'mistake' but a cynical attempt to improve profits at all costs. Someone high up at VW sanctioned this course of action, and ALL car manfactures need to be shown a clear message this kind of action cannot not be allowed to happen ever again.

  • This has to be very bad timing for VW considering the pope is on a tour in America promoting the environment. And I don' t mean the popes, ex Shane MacGowan backing up band.

Though I wonder if they will use them 2 old people in their next advert. Much will depend on the quality of their next tv advert.

  • Yes. If your invoice clearly lists out the oxides of nitrogen levels and all other relevant emissions compliance data and testing methods and criteria, you may have a case.

Otherwise the manufacturer will simply ensure that your car does indeed meet the criteria for it's certificate of conformancy with a recall and in so doing you won't have a case.

Its not as simple as either of those points.

On the first, it would depend on how long the person had owned the car, and then on that length of time there would need to be a calculation of how much benefit the owner had had, and a compensation value would be based upon that.

On the second, if the VW car is chipped so it meets the NOx levels that real life driving produces, then you will have a serious effect on economy/performance, which takes you back to the first point.

In very simplistic terms, its a classic case of being sold a product that was not as described.

Have you been missold TDI at any time in the past six years, if so you could be due compensation*, simply call us on 0898 VW LOLZ and see if you can claim.

*Compensation may be 40% worse than advertised

The euro 5 emissions standards are set down in EU law, what if it is not just a simple recall fix, tweaking the software may not give an adequate reduction to meet the criteria. ? To achieve Euro 5 they had to use the defeat switch to run the test engine extremely lean with detonation adjustment which would make it unusable on the road under load. To meet Euro 6 VW group have had to introduce AdBlue technology to their diesels

  • I was going to create a thread based on this very topic - being sold a VW which isn't as described... So where do us VW owners actually stand?

I currently have a VW Golf 2.0 TDI that I got in May 2015. This is on a hire agreement and since hearing this, I seriously just want shut of my Golf now.

Is there any clause where I could simply terminate my contact based on the facts that the cars have been sold with the wrong emissions etc...? Seeing as they've breached their side of the contact, surely it gives me the upper hand to return the vehicle?

Well, you're at the advantage here as you have your contract in your hand and we don't. So, are you saying there is actually a clause in your paperwork that says this?

What are you hoping to change the car for? An EV or another ICE powered one?

did you intend to keep or return the car?
If its return, then your only issue is whether you are happy with the fuel costs. (which you have been paying already)
  • I got the Golf R Line instead of the Golf R simply based on the fact that I hate spending money on fuel when I don't need to; I wanted a nice looking car such as the R but could not justify the fuel costs attached with the R. I opted for the R Line which offers a more economical engine but even with my careful driving I still can't get the advertised MPG out of it - even when driving it in 'Eco' mode.

What should I be looking for within the contract? I simply want shut of the Golf as I only suspect this is going to get very sticky with VW. As for which car next- I don't know. I hadn't thought that far ahead yet!

Why exactly do you want rid of it? You have a car with superior performance than all those that are about to come after this debacle!
