POPLA have distanced themselves from this because UKPPO are labouring under the impression that their parking tickets are 'penalties', despite the fact that the bylaws don't exist, and UKPPO have no other statutory authority. POPLA don't do 'penalties'.
These tickets are actually speculative invoices - same as other PPC tickets, nothing more, but they would so love it if the DVLA and BPA would believe that these WERE actually penalties.

Over a week now and no more contact from BPA of DVLA.
I have sent a file to the IOC and received confirmation they are looking at it.
My MP has been contacted again to follow up her promise to contact UKPPO but nothing yet.
Its a waiting game eh?

I got this reply from the BPA this morning ?

I have reviewed the e-mail trail in this case and note all the relevant issues that have been raised. The one that is left is the issue of whether or not UKPP are acting under the byelaws of Newcastle Airport.
I can confirm that this is the case, this issue has been raised in previous complaints by other motorists, and the response is the same.
The parking operator has a current contract with the Airport to manage the parking/drop off areas and issue Penalty Notices under the Airport Byelaws.
See copy of Byelaws attached.
There has been no breach of our Code of Practice, and I am closing this case.

The copy of the bye laws attached contain section 6 (as I am sure you are aware ) :-
6. PROHIBITED ACTS ON PRIVATE AIRPORT ROADS ETC.
Specifically :-
6.2 Parking in Time restricted Areas
Leave or park a vehicle or cause it to wait for a period in excess of the permitted time
in an area where the period of waiting is restricted by notice.
6.3 Parking in Prohibited Areas
Wait in, leave or park a vehicle where waiting or parking is prohibited by notice.
The vehicle was not left or parked and the driver did not wait or leave the vehicle (except for a period shown in two photographs on the PCN 2 seconds apart ? A pick up.
Can I now re appeal to BPA as this email states case closed?0 -
Yup, make them re-open it. Nothing in the attached byelaws allows them to issue penalties or gain access to the DVLA.0
