  • So, UKPPO stated on previous pcn, popla was available, UKPPO wanted them to hear them, popla wouldn`t hear them. So UKPPO took the popla bit off their pcn and continued to issue pcn knowing popla wouldn`t hear them and still accessed data from dvla! Is this breaking the CoP?

    It would be if they were bylaws enforced penalties but they are clearly not!

    Hello again

    I received two letters today, one from my MP who informs me that she has now written to UKPPO twice and is awaiting a reply?
    Also one from the DVLA Customer Complaint Resolution team, in respect of my letter to Mr Oliver Morley Chief Executive DVLA. it states my letter is receiving immediate attention.
    It is also 9 days since I asked David Dunford at the DVLA to escalate my complaint. Should have reply soon?
    Nothing yet from the ICO.

    The BPA are investigating certain isues raised by yours truly, and the DVLA are aware. Can't promise a resolution but in my view these are either:

    - A Parking Charge Notice where the word ‘parking’ has simply been changed to ‘penalty’ (a very serious breach of the CoP), or

    - A Penalty bylaws ticket where there has been a serious ICO breach, inappropriately sharing the DVLA data with a debt collector when the route for enforcing a real bylaws tickets cannot involve ‘debt’ collection nor the County Court.

    That's it. I think UKPPO are between a rock and a hard place and I'm trying to force it into a very hard place. If this first complaint gets nowhere it's being escalated.

    Just got this in my response to the formal complaint I made to Mr Oliver Morley,

    "Dear Mr //////////////////
    Thank you for your letter of 20 October, to our Chief Executive, Mr Oliver Morley, about the penalty
    charge notice you received from UK Parking patrol office. Mr Morley has asked that I reply on his
    behalf.
    I am sorry you have had to contact us regarding this matter and for any inconvenience caused.
    I can confirm this has already been answered by my colleague Mr Dunford on 19 October, it
    appears duplicate letters were sent to different departments.
    Mr Dunford has stated DVLA is satisfied the UK Parking Patrol Office have the authority to manage
    the area in question using the Byelaws.
    I have attached a copy of Mr Dunford’s reply for your convenience.
    I trust this explains that position for you but if I can be of any further assistance, please do not
    hesitate to contact me.

    Seems like they are not budging on this. Who can I escalate to now?

    I guess you could ask them for a full and detailed explanation on how they think sufficient authority is present to use the byelaws, since all the evidence points to the converse?

    Quote what I said, it's not about whether they 'have the authority to manage the area in question using the Byelaws'. They do (sort of).

    It's about the fact they are NOT doing either. You need to spell out that the issue is given away by the debt collectors pursuing people re a CCJ in the County Court, after the six months for enforcing a bylaws penalty in Magistrates' Court has passed!

    IMHO it's one of the two scenarios I've suggested - repeat the two scenarios back to the DVLA and BPA.

    Don't argue it any other way IMHO. My complaint hasn't been kicked out yet so jump on the back of it by all means and repeat to the DVLA what I said (you don't have to mention this forum or my username!) the DVLA & BPA know who raised the above 'it's only one of two scenarios' complaint and it's being chewed on by the BPA still). Repeat it and 'make it your own', as they say on the X Factor!

    I intend to escalate it to the ICO, Action Fraud and other places if I feel I'm not getting anywhere.
