You could reply stating you are not asking for their legal opinion; you are asking them to justify why they are giving out data when reasonable cause was not demonstrated, due to the fact it's clearly not legal. You're telling them outright that the parking enforcement is not lawful; even UKPPOs behaviour indicates that it isn't lawful (going for small claim route rather than magistrate).
You could also offer to invite them to join UKPPO in court should they try it on. Or ask them what to do when your court outcome is that it wasn't lawful?
You're probably stuck pestering your MP and the ICO, whilst trying to goad UKPPO into taking you to court. It's unlikely they will as they know they'll lose, so I'm not sure if it's worth trying to play gullible to see if they think you are an easy target.0 -

Just got a letter from a debt collection agency saying 10 days to pay £160 or court proceedings??

That letter chain is your proof that this isn't a bylaws ticket - you do understand why? You show it to the BPA but you have to explain it right.

Ask Peter Beasley at the BPA (if he's the one who fobbed you off) to please refer the matter to Gemma Dorans who is already considering this exact complaint and attach a copy of the letter from DRPlus - and explain why that proves it's not a PCN issued under bylaws. Stop bothering the DVLA about it - this is a BPA complaint at this point and any other complaints are sidetracking you.

I have asked Peter Beasley BPA to tell me how to now apply for POPLA. No reply yet? Is this still worth doing?
Also I have asked all the questions related to me via forum members about the illegality of providing my details wether in or out if the bye laws to both DVLA and BPA.
I will hit the BPA again tomorrow with the fact again that it is not a bye law issue.
I see the civil court deference and will relate that to the BPA also.
I will also try the Gemma Dorans route. Thanks for that as I am sure DVLA have washed their hands of this.

Hello. I am confused as you said in post117 that debt recovery via county court was the give away.Mydebt collection letter mentions civil court.

Civil court, county court, it's the same thing. CM's point is that if this were a byelaws ticket they would be threatening to have you prosecuted at the magistrates court - a criminal court - not (vaguely) threatening to sue you in a county/civil court.
I disagree with CM about the complaints. The BPA is a waste of space, it's your MP you need to be getting through to now with a view to a possible escalation to the Parliamentary Ombudsman.Je suis Charlie.0 -

I wonder what the BPA think about that after defending to the hilt UKPPO's rights to issue dodgy tickets at NIAL.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
