    Dell may be able to ignore letters, but it won't be able to ignore a court summons - if it does the claimant wins by default.

    I await the evidence of any successful " Court Summons ".

    I agree completely, waiting for all our supposed amateur legal eagles to put up or shut up,if someone actually takes this to court and wins I will be the first to say I'm wrong, but at the moment all the posters who are posting hot air rubbish are wrong and should keep there traps shut.
  • We can discuss all we like about Dell not giving anyone anything etc etc or how sad it all is that folk are chasing it up.

    One thing that is not on is that i have still not got me refund which i was told over the phone would be in my account Wednesday-friday, I already said this was unnaceptable, It is still not in????

    I emailed them on friday evening to ask what they are playing at and they have had my money for 12 days, I said do not send a computer genertaed response either. Well i got the computer response but no more info on the money really. Im almost tempted to push this all the way becuase of this refund. They offered me 10% off anything over the phone as an apology, seems you only get any "compo2 if you order something which is also a joke.

    I think the refund time is shambolic.

    And you still think that people who are p***ed off with Dell are sad??!!

    I mean how much abuse do you want people to get from them before people like you start showing at least some sympathy and not post silly comments??

    I may not be a legal expert, but I am serious. I can read a set of terms and conditions as well as anyone else and I believe there's a case to answer.

    I have been in court a few times having taking big companies to task and hit the national daily headlines earlier this year for being the first person to take a bank to court, win the case and then have to get the bailiffs in. For what? £30.

    If people like me don't stand up and say "No", then companies like Dell will run roughshod over all of us.

    I don't want to have to take that kind of action an am attempting to press Dell into a negotiated settlement. Given this and the prejudice that posting on here may have, I will not post again.

    As in every case, each and every one who's been affected by this should deal with it in a way that they are comfortable with and having people posting glib comments is simply unhelpful.

    What astonishes me is the ready acceptance of today's society to be shafted time and time again by all-powerful corporations (and government) and just sit back and accept it. This attitude simply encourages these people who have an unfair advantage of money to do it again and again becuase it's easy to get away with it.

    It's been easy to get away for bank charges for years until a few people challenged it. Now, this year alone, it's estimated that over £400 million has been repaid to customers in unlawful charges. That's real consumer power - if you don't want that power - stick to read-only mode as you're not posting any messages that are remotely useful to others.

    I admit, a legal challenge is never guaranteed to fall in your favour. It's a tough call and will take time and, probably some anguish. It's not for everyone and it's for each to decide how to deal with it.

    My comments on here have been aimed at providing hope and encouragement to those who are tenacious enough to press the issue. At the very least, pressing the issue is better than accepting the situation as it stands.

    Please take your offensive and unhelpful dialogue elsewhere, leave this thread to those who are trying to reach a satisfactory outcome, progress is being made and your banal contributions are simply littering the pages.

    Well get on with it then you hero, talk is cheap.I have seen many of these misprices on here and other bargain forums over the last 3 years and when they have not been honoured people spouting on about taking the company to court, I have yet to hear of ANY successful court action,maybe if someone who wants to sue them, took as much time in the lagal action as posting brave and heroic statements on here someone would win, in the meantime I'll get on with my life.

    er read my post again i was having a go at folk who were calling the folk moaning at dell sad not what you have said, Im one of the ones having a go.
