my response from dell this evening :
"We understand that you are not satisfied with the explanation you have received so far. We thought it may be useful to set out for you in further detail exactly what happened and why we have taken the decisions we did.
As we have explained in previously, the error arose because two manufacturers have used identical product codes for two different products. This is an extremely unlikely scenario which has never occurred before. It meant that our ordering system displayed on the Dell website a product code for one product and a product image and description for another. When you thought you were ordering the Iomega HDD, our system was processing an order for a completely different product. In fact we are not alone, as we believe that other online retailers are having similar problems with these products for the same reasons.
We took some time to realise this error had occurred, as our system was operating on the basis that the orders taken were orders for the other product, which is in stock. This is why some people received delivery dates and we took payment from some customer's credit/debit cards.
The error only became apparent when high volumes of orders started to be placed which triggered internal notifications and lead to us identifying the problem and its cause and resolving the issue.
As previously indicated the product in question was discontinued and so it is not possible to supply it. We have fulfilled orders for other different HDD's at correct prices and we understand that some customers may have become confused by this.
We do not have equivalent product at the clearly incorrect price point that was shown erroneously on the website. Consequently we have had no option but to cancel orders in these circumstances in line with the position stated in our Order Confirmation:
"Dell will not be responsible for typographical, pricing or other errors and reserves the right to cancel any orders based on such errors"
You have queried the position under contract law. We understand that even if a contract was formed, which is denied, we are entitled to cancel it in this situation.
However please email us for any further concerns and we would be glad to assist you."
looks like we will al be getting the standard, impersonal, "now go away little man" response ...

you might as well forget it who would actually want anything from dell in the first place...I have never had anything from them because all my friends have warned me off them in the past I ordered a hdd just because they were so cheap..but at the end of the day this is just another nail in the coffin for dell they would have probably been aload of crap anyway...from dell...come on...who goes there...no one with a brain in there head at least...dell are idiots...:rolleyes:

dell had the nerve to ask me how theyre customer services had dealt with my problems....
none of them understood me !!!!!!:(
my pc is dell, but ive lost all faith in them now after this fiasco and how they dealt with it all... i also cant abide foreign call centers:cool:minds is willing , soul remains, this woman cannot be saved :cool:;););););););):A;);););););););)

Do not give in. Dell is playing us all for mugs. I fully intend to take this to Small Claims to have Dell's T&C tested. I do not believe that Dells T&C can be modified by way of an external document (in this case the confirmation) that states that they can cancel if they make a mistake. There is no clause in th T&C that permits this, and even if there were, it may be the case that the law would see this as unreasonable given that Dell could then claim that any additional modifcation was sent in order to prove their case or disprove a claimants.
Dell seems to be wanting this all it's own way and we should be making sufficient noise to prevent it getting it's own way.
But Dell is in a bit of a quandry - it's like the bank charges scandal. It's in this up to its neck - lord knows how many hard drives it is contracted to supply. If it conceeds, it's in for quite a lot of damages (however it deals with them). If it goes to court, it risks the same outcome. It could try to settle some of the more prominent cases and insist on a gaging clause to limit damage.
In the mean time, it's probably best that we try for publicity and each deal with the issue in our own way.0 -

I think that, given that Dell is one of the largest providers of PCs in the world, the phrase "it's just another nail in the coffin of dell" is just a touch wide of the mark. We're not talking about an Enron style scandal here.0 -

Has anyone been refunded yet? I ordered on the 14th, the money was taken from my account on the 15th. I received my first e-mail cancelling the order on the 17th - and it said I would be refunded within 5 working days.0
