network q garage - wrongly advertise mileage

    I have never even heard of a vauxhall cascada until this post, so had to google it-looks very nice.

    I would just enjoy the car and not worry about the mileage being just 2k higher that advertised, but i would ask the garage to fit a bluetooth kit as a goodwill gesture, im sure they will if you ask them as it was advertised with one and the miles were slightly hire than advertised.

    I don't know how you can spend so much money on something and not check this sort of thing...especially the mileage!

    Do car adverts not almost always state the description may not be 100% correct because they don't sit and write each one out, they use templates?

    I didn't check whether it only had one previous owner, been in a serious crash etc etc,

    BECAUSE It was a Network Q car bought from a Vauxhall dealer. In the contract / invoice for the car they have stated the mileage was 11341 miles. So they dint check either.

    The car advert had no disclaimers at all on description or mileage. the sales of goods act 1979 places a clear emphasis on dealers to ensure the car is as described and they provide no misleading information.

    Problem I have, I do not believe you can install a fully integrated blue tooth kit in the cAr ( having done some research). But I am waiting for the dealer to get back to me on how they plan to resolve.

    Well, one would expect it to be, 26 years later. It's 'Bertone' just for reference.


    Anyway, the fact remains that the Cascada is built on the same platform as the Astra, shares many components with the Astra, and is built on the same production line in Poland.


    So, in most respects, it's a convertible version of... the Astra.

    A genuine error, however, would not be seen as grounds to reject a vehicle - especially when the financial implication of the 2K miles you're obsessing over will, in real terms, be utterly negligible.


    The dealer could, quite genuinely, have erroneously entered 11,341 when they meant to enter 13,341. Or even 13,431 - I must see and correct two or three typos of that kind every day in the documents I commercially review, and I'm sure there are some I miss.

    Sorry, but not true.

    I've just looked through a few ads on the Network Q site and every single one of them states:
    Every effort has been made to ensure the accuracy of the information above, however, errors may occur. Do not rely entirely
    on this information but check with your centre about items which may affect your decision to purchase.

    Given that disclaimer I think it's going to be hard to argue any kind of SOGA comeback against the mileage when the correct information was, quite literally, staring you in the face.

    For the bluetooth yes you have a point - If your car was advertised with a feature that is not immediately obvious to be missing on a cursory check then it is clearly expected to have that feature and the garage should ensure you get it, but mileage is by its nature transient, the figure quoted on an advert is inherently no longer correct after you alone take it for a test drive, and I struggle to see how "I didn't check it" could fly.
    It isn't like you had to hunt around for it, its like complaining that the car is labelled as being blue in the advert but then the one you pick up is red and saying you "didn't notice".

    I think you are fighting a loosing battle if I'm honest, unless you are missing a part of the story where you asked if the car had bluetooth and the salesman said it did?

    The dealer may do a good will gesture because of that and the mileage, but just enjoy the car and learn for next time to check everything is as described.

If the vehicle does not correspond with the description, you will be in breach of contract.
    You may also be in breach of the CPRs."
