OK will do that this weekend, but it does feel like a bit of a cop out after all the advice I've received from various people on here particularly with the view that they would never dare take it to court anyway. I'll post my letter for approval if that's ok?
Maybe they will continue to pursue me as keeper anyway, then I will carry on as I have so far, and if they push me all the way to court the admittance of my brother in laws involvement would make it all the more interesting.0 -
They're very unlikely to take this to court, so your 'moment of glory' is probably never going to happen.
The purpose of the exercise right now is to test their reaction to the truth - will they be prepared call you a liar? Their response will be very useful should it ever get to court.
'Going to court' is not an option you should be looking for. There are those who pop in and out of here occasionally who might be offering you encouragement to take a wanton and cavalier approach to 'going to court', but, for sure, they won't be around rolling up their sleeves to help you put together a significantly more detailed and intense set of documentation than any initial appeal to the PPC or the second stage level. There are definitely no templates for a court defence!

Thanks Umkomaas, I'm not gunning for a 'moment of glory', but I wouldn't shirk away from it if they try to use me as a test case!
They've already (as far as I can see from the advice I've had) broken every guideline in the Practice direction, letters, timings, lack of the offer of an IAS appeal, no PoFA2012, the red 'notice of court.....' appearing in the address window of one of the letters, passing it on to their bully boy debt collectors BEFORE informing me, saying I cant appeal because I'm out of time (oh the irony), the list goes on. I'm putting the 'Silver Bullet' letter together this weekend and sending it ZZPS. I'll put it on here, see what people advise then take it from there.
And yes it will be interesting if they call me a liar, but it all adds to a paper trail that I'll need if they do push it all the way :-)0 -

I have already informed your client VCS LTD in a letter dated 18-08-2015 that I was not driving the car on the day of this alleged ‘offence’, and that the driver was in fact a gentleman who was visiting from abroad, therefore I am not liable for any payment of the invoices yourselves and VCS send to me.
I have taken some advice, and it was to pass on the gentleman in questions name and address so you can take up the matter with him and quite frankly stop wasting my time.
The gentleman who was driving is

who lives in the Phillipines)
I trust that this is now an end to this matter.

It is certainly enough to hole them below the waterline in court, whether it is enough to force them to call their dogs off is another matter.

If you get a letter from Wright Hassall, you can send an official complaint to the Solicitors Regulation Authority if they claim that their client (who will be ZZPS, not VCS) will take you to court.
Come back if it arrives.
Well ManxRed its arrived today. Not sent letter stating relative from overseas was driver yet (hold hands up I partially forgot due to other problems). Also I have noticed that this letter isn't signed, surely that means its not worth the paper it's written on ?
What is next step please? And if its a complaint to the Solicitors Regulation Authority is there a draft letter anywhere please?

I'm afraid there's no draft letter, just email them with a copy of the letter and point out that it's incredibly misleading. They know they won't take it to court because they know their client is not entitled to take you to court; they go on about applying for a CCJ to intimidate you, even though they'd only apply for a CCJ if their client took you to court (which they can't), you lost (which you can't) and you then refused to pay up (which you wouldn't).
It's all aimed to try and threaten you into paying up by taking advantage on the fact that you're not likely to be legally trained. It's not solicitor like and bringing the industry into disprepute and they have a bad rep for doing this sort of thing so it's not a one off. You also suspect that because the content is so dubious, that Wright Hassal are merely allowing a debt collector to use their letterhead, which is another no-no.
The SRA probably won't do anything individually about it; but enough reports and they'll have to do something.
You can always send a separate complaint to one of the partners at WH about the whole thing.
The whole aim is to make it too painful to get involved with these parasites.0 -
I actually thought they may be a made up company, as 'Wright Hassall' (right hassle?) is what they are causing me along with, no doubt, thousands of others.
I'll email the SRA over the weekend, do I mention the fact that they cant take me to court, get a CCJ etc as they aren't the original company who issued an invoice or landowner, and that they are trying to intimidate me (which they haven't)?
I think I'll send them a letter and charge them £100 for my trouble, see what their response is.0
