ANPR IS ANPR , not a bloke with a camera , !!!!!!!! to the DVLA
the offence cannot be recorded by ANPR cameras , they simply check the number shown and compare it to any others recorded in the last "x" hours , at no point in the creation of the POFa 2012 was the use of CCTV or a "bloke with a Samsung" agreed on or made law.0 -
So enfield freddy, am I correct in thinking that what you are saying means that what they did in the first place ie identify my car allegedly stopping on a road using ANPR cameras isn't legal?
If not why do they continue to use it to persue and harass people?0 -
I dont think he said it wasnt legal
but it can be more problematic to prove their case in law when its being used on private land, plus if it was a hand held camera like the UKPC debacle it would be even worse
something "illegal" is against the law, therefore a law must apply in order for it to be broken , like UKPC and the Fraud Act etc
private parking is not regulated so the law is tested every time a court case happens , aka as per the barry beavis case
in that case, some case law will be set when the 7 judges set it next month , which may or may not include mention of ANPR (which was used in his case)
they do it because of the grey areas in law and its used to harass and bully people who dont know case law and are not legally trained, most people coming on here think that when they get a DC letter the bailiffs are coming round to nick their possessions !0 -
Ok thanks again for the info, I'm still currently in the early days yet and in the 'ignore the debt collectors' stage (which I will, I'm not easily intimidated and especially with all the advice I've received on here, quite happy to stand up in court as well if it gets to that which I gather is highly unlikely).
What has puzzled me is that VCS never offered a Popla or IAS appeal, they just passed it on to ZZPS after I requested they fall in line with the Practice direction.
Are they showing their hand early ie this bloke isn't going to cough up, let ZZPS try to bully/intimidate him?0 -
Received this from ZZPS this morning. Two letters in 13 days. They seem very keen. Is this their normal approach?

If you get a letter from Wright Hassall, you can send an official complaint to the Solicitors Regulation Authority if they claim that their client (who will be ZZPS, not VCS) will take you to court.

Also they haven't gone down the Pofa2012 road that I believe makes the keeper (ie me) liable?

VCS are in the IPC so normally offer IAS as an 'independent' appeal. And I use the word 'independent' very loosely as they aren't independent in the slightest.
They don't use PoFA, so they are reliant on proving 'on the balance of probabilities' that the RK was also driving. That's their onus, if there's any doubt over that then simply tell them to take the matter up with the driver and get lost.
They are more reliant on unwary recipients 'outing' themselves in an appeal.
For example, 'I parked the car and then did this, and then did that' etc.
That's probably more profitable for them than having to follow a load of tricky criteria in order to make the PoFa work for them.Je Suis Cecil.0 -
So just to clarify, if I tell them who the driver was (I've already told them I wasn't the driver and the person in question lives abroad in the second letter to them) are they likely to go away? Or not?
I know as informed earlier there is no 'silver bullet' but it'd be better if they would just !!!!!! off as I'm not paying them a bean.0 -

Enjoyed your thread - I too am fighting VCS and found it useful to see how they are treating you. I think you're slightly ahead of me, so please do continue to upload photos etc - so I know what to look out for!
Also agree with your first comments that they seem to make up their own rules to suit!0
