You could name the driver but that does drop them in it.

They cannot do jack sh*t if they know you weren't the driver. Do you have any evidence that you weren't? Witness Statement from someone you were with (at a different location) at the time?

Follow the advice given on here Zoonyx, some very learned people on here who have a far greater knowledge of this issue and the rules/laws that are concerned with it than I can ever hope to have, but I'm learning some of them. Were you also at Doncaster airport and can you post your letters using Photobucket same as I have?

Also it was wife's brother who was visiting and lives in the Phillipines, but I have nothing to prove I wasn't there, can't even think what I was doing so it looks as if they'll continue to waste their time chasing me.
I've not told them yet just told them it wasn't me and the driver lives abroad.
VCS have said (in their last letter) that they will no longer enter into any correspondence anyway, but they haven't any proof of who was the driver either as the photos of the car appear to show no one at the wheel!

If the driver lives in the Philippines then go ahead and name him. They're screwed.

Especially if he provides a Witness Statement to confirm this.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I've posted 1 but will attempt to post the rest when I'm home.

Not at Donny airport no - although it's local. Was at a retail park 'no stopping zone' which they helpfully described as an 'airport access road and high security zone' haha. Seriously - they're inept!

Currently they are refusing the named driver (don't ask!) an appeal, but they change their minds like the wind anyway.

    Keep at em!
  • Well I can try get one from him, bit much though that they are still chasing me as RK, not via PoFA2012 and didn't offer an IAS appeal no matter how biased the IAS is, took 11 weeks to reply to my first contact with them then said it was ME who was out of time so no appeal could be heard!

They aren't following the Practice Direction either so I don't believe they would dare risk court proceedings anyway.

If you do get that Witness Statement try to get on paper with some Phillipino typeface on it, to prove some authenticity, rather than just on plain paper which anyone could have knocked up.

They are pursuing you not as Registered Keeper per se, but as the person they assume was driving. Now you can prove that it categorically was someone else (via a genuine Statement of Truth Witness Statement), they then have no case against you.

  • I'm going to keep that in my locker for a while see what they come up with next I think. Play them at their own game, think it might also help others in similar positions who might not have this 'get out of jail free' card.

I've realised very quickly they're a nasty bunch who try intimidating and bullying people out of their hard earned, but I don't fall into that category.

Not that there's any track record to date, but once court action is initiated your 'get out of jail card' is redundant. I wouldn't mess around too much; get it over and done with!

  • OK will do, although I have already told them I was not the driver and the driver does live abroad. I'll send them a letter (or will e mail do?) telling them the bad news, see what their reaction is.
