  • Hi, I have a similar question: My husband has now retired and on State Retirement Pension. I am aged 60 and currently unemployed but have recently worked for 6 weeks as a Christmas Temp where I paid tax. I am looking for work but obviously cant predict whether or not I will get a job (I'm not claiming any benefits). Who should apply for this Marriage Allowance - me or my husband?

    It is not an extra allowance. You transfer 1060 of your personal allowance to your husband. So your allowance goes down and his goes up. So you need to apply.

    Your husband has to be paying basic rate tax to allow this.

    The question you need to ask yourselves is who is going to be getting the most income over a full tax year. In general, the greater earner would be better off receiving the transferred allowance. The person transferring (giving up) the allowance must apply for the transfer, not the receiver.

    The problem in your case is that you seem to be in and out of work during the year and you might not be liable for any tax at all over the full tax year. Some or all of the tax you have already paid will effectively be refunded through your tax code by your next employer(s).

    From <HMRC> site
    To benefit as a couple, you - as the lower earner - need to have an income of £10,600 or less. . . .You can get Marriage Allowance if your partner’s income is between £10,601 and £42,385.
    But, as said above, state pension does count as income.
