PPI Reclaiming successes and failures

Only one minor point, as my card has an outstanding balance they are saying their policy states the refund has to be credited to my card account to reduce the oustanding balance - is this normal practice??
My father in law is claiming on a PPI on a loan he took out in 2003 and today he has been offered £9000 refund.Great result!!
However as he still has the loan with HSBC they are trying to ensure that the remainder of the loan is paid off first, with any money left from the refund, which is apporoximately £1000, being refunded in the form of a cheque.
Can they do this or as the PPI is a different entity than the loan can he just ask for the whole of the money to be refunded??0 -

I emailed my complaint to Egg regarding PPI on an Egg Credit Card on 28 May.
I received an acknowledgement on 3 June stating the standard 8 week response time.
Received a further letter this morning, confirming they want to offer me a full refund of all premiums, plus 8% interest - total of £1758.98!!!!!
Total result for very little effort on my part and this cost me nothing as I emailed my completed FOS questionnaire to them.
I am really, really pleased, thanks MSE!!

Either way, it's reduced my total outstanding debt by £1758.98 which is a good feeling!

Hi there
On both the Card account and your dad's, as long as there are no arrears (missed payments) you should be entitled to have the money refunded how you want it refunded.
I would therefore on both accounts write to tell them, there are no arrears and as you were out of pocket in the first place from being mis sold the policy, and wish to have the PPI refunded directly to you.
Any problem, contact the FOS for advice on this.

I have only just noticed that both egg and hsbc have been charging me ppi on my credit cards! I have had both cards for almost 5 years and had never been charged ppi before? Why have they started now? Just looking at the letters to get this sorted.0 -

Many thanks for the advice. I will email customer support at Egg to request the payment to me, as my account has never been in arrears. I have no paperwork that states this is their 'policy' so would be interested if anyone else has had the same issue.
Will post an update as soon as I hear back.

Are you sure they did not add this when the application was taken out, for example "maybe after you signed the application";)
You go for it and ask for any help if required.

I rang customer centre today to check they had both acceptances.
amazingly the one i sent on monday they have, but not the one i posted thursday before( but the nice young man did inform me it prob was in the building), didnt inspire me with confidence.
I asked how the calc the credit card , and was told they go back to when it started which was july 2003, I was shocked as the card was open around 1995/1996 as being naive it was when i turned 18 and could first get one which got me in trouble.
He assured me he only has a basic system and they would check all old cards and linked cards etc...But im a little worried as i dont have any old statements got rid when i went onto a dmp 5 years ago.
Would anyone know from experience if Lloyds do check thoroughly or is it another battle to get back everything from day one. I dont undertsand how there offer is to put me in the position had i not had PPI, but dont see how they can do that if they only go so ar back
Does anyone know if they have to keep records since the start if the account is still active?
