Hi All,

I have has 3 personal successes from help with this site.

I am currently trying to claim back mis-sell PPI for my parents and am a little confused by the reply from Lloyds. Any help would be appreicated.

sent first letter, and they denied that PPI was added to loan, even though I included copies of the agreement, showing the added PPI. sent a second letter stating to actually read my first letter and included documents, I highlighted the added PPI on the copy agreement. Also asked them to look at a second loan taken after the first loan in the first letter (hope thats not to confusing!!!)
Have had a reply saying that my parents took out a loan on 17th sept 2007 for £14,500.00, and they elected to protect their risk by purchasing an insurance contract for a "one off" premium of £4894.00. which they did not, as they told the salesperson that I would be able to gaurantee payments if anything was to happen.
They have written back with several jargon saying they signed, etc etc.
They state in the letter that they settled their loan on 5th September 2008 and they received a net rebate on the loan PPI for £3955.85, this was used to reduce their loan settlement figure.
They also say when the policy was bought it was explained that the rebate was based on a sliding scale due to the claims risk being greater at the beginning of the loan and they are preapred to offer a more favourable rebate on a pro rata basis as a "gesture of goodwill" on this occasion.
A pro-rata rebate would of amounted to £4212.28, and Lloyds would like to offer £258.43 as a refund!!!
Can anyone just advise me if the PPI was added in the beginning, and it was stated that they didnt want it. Can I write back to Lloyds them and ask for the full amount that was added in the beginning, when it should not have been.

They are obviously guilty of something to make an offer of a payment at all

Sorry this is so long.

Hi there

First of all well done on all your successes, Congratulations!

LLOYDS annoy me so much and it would not surprise me at all if these are one of those companies to be fined...... (See news thread).

They are one of those who don't look into complaints properly and then when you argue this they try it on with a low goodwill offer!

I certainly would not leave it there.

All the letters to customers are basically the same....apart from the offers which are mostly low anyway.
What they have sent is bog standard, signed or not your parents still have their reasons here.

If this was the final response, still write back to them, because they will look into to it final or not.

I would argue that you feel this complaint was not investigated properly, and they have not taken it seriously. (what a shambles made by LLOYDS yet again)!!!

However, it is up to you if you want to take this to the FOS on this now, I take it they have enclosed the FOS leaflet and still given the opportunity to write back with further information??

If your going to write back to them, only give them 7-14 days, this letter will have to be stronger now, they have had an opportunity to investigate this properly but have obviously not taken it seriously, keep at them.

I would write a hard copy to send in the post and email an attachment letter to this email here:
customer.care.insurance@lloydstsb.co.uk
and copy it to
eric.daniels@lloydstsb.co.uk
(the chief exective officer) CEO
He needs to know what his staff are like - especially now with all this news in the media.
Ask them to investigate again, as points were missed and this was not investigated properly.

Honestly what an insult from LLOYDS once again!!!

If you have any probs with the emails, let me know.

Good luck with this and please keep us posted.

Thanks so much Di, you are a star.
Will follow all your leads and hopefully get somewhere. To be honest I thought Lloyds would be awkward from looking at the threads.

Many thanks again. Your so speedy with your replies.

Your very welcome.

They make me so mad, they are not interested at all and just basically go on about how trained their staff are and so on, its all about them!!!

For every reason they have given on their finding - write some points about them, play at their own game.

They had a responsibility to ensure the eligibility of the policy, considering they are supposed to be "trained".
They did not sell this policy on the interest of your parents, and your parents are out of pocket and have been deprived of their money.

I'm sure it will all work out in the end, fingers crossed.;)

Just an update on my claims, Blackhorse state I never paid PPI which is fine as I wasn't sure and they sent me copies of agreement. Capital one have messed me around, returned my letter and asked me to write to their loan complaints which I did 2 weeks ago and no news. I wrote to citi on the 17th April, they sent me a standard we are sorry you complained etc and said they'd investigate, then yesterday they wrote for a copy of my complaint as they state they have lost it!! Then Welcome finance, I wrote to them quoting he account number and PPI number which was with them, they wrote back yesterday quoting a different account number which didn't have PPI!! I have re written to CITI, Welcome and capital one by recorded delivery yesterday so here's hoping!! I do feel they are using delaying tactics!!!

Hi and thanks for your update.

So sorry to hear of the messing around.

I know its a pain to have to send another letter, but have you also completed the questionnaire that the FOS have recently issued?
You can send one of these to the banks as advised by the FOS, keep a copy as it will save time in case you end up taking them to the FOS.
You should find this on Martin's guidelines of reclaiming here:
http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance

and more details with the questionnaire on the FOS pages too here:
http://www.financial-ombudsman.org.uk/consumer/complaints.htm

http://www.financial-ombudsman.org.uk/publications/technical_notes/ppi/PPI-consumer-questionnaire.doc

If you remember the dates when they received your original complaint letter, tell them as its no fault of your own that they admitted they mislaid it you expect to hear from them by 8 weeks as from the date of the previous letter.

Hope this helps, good luck and we look forward to hearing the outcome.

Hi All,

Been a bit absent of late but my gosh, have we had some successes in our household :)

My partner has had £2600 back from Tesco Loans. We only sent one letter 5 weeks ago and had the cheques arrive last week. I have just had £204 credited back to a credit card that only had a balance of £490 so we can now clear that with the extra cash we have got from the Tesco Loans.

I'm still awaiting the FOS decision on whether or not I am entitled to the £1400 Welcome Finance said I owed in arrears, when I didn't. The main thing is that the loan is finished and I no longer have to make payments ... despite them still showing on my credit report that I have missed 6 payments and still owe £1400 but hopefully the FOS will sort that. Also still waiting to hear from Santander regarding my partners past loan with them. Fingers Crossed as I have a wedding to pay for considering we got engaged last month!!!

Thanks for all your help guys, you've been great! x
