Feeling disheartened today, I received a letter from the FOS advising me that they cannot do anything about the PPI that was attached to my credit card by Amex back in 2003 and that I was still paying until last month:mad:
It would appear that American Express Insurance Services Europe Ltd was not covered when the advice was given to me in 2003 as they only became regulated by the General Insurance Council on 3 November 2004.
Looks like Amex have made a huge amount of free money out of me and I have no hope of ever getting it back:mad:0 -

of course you can - you need to start proceedings in the County Court - don't let them get away with it !!!!
The thing is I don't know much I have paid over the years and Amex are unable to tell me because they have admitted they don't keep records. Also I haven't kept my credit card bills going back that far, I just pay them and shred them:rolleyes: .
I am unemployed and cannot afford to make a claim at the county court.0 -
Hi there, new to this for posting comments but have been watching these forums for months/years.
I have had a number of loans and credit cards (too many) over last few years, some in my name only and some with my wife. I was self employed and my wife has had diabetes since she was 6. I have written to all the companies using the templates and thought i would share the successes with you to give other people hope:
First Direct Loans and Credit Card - I received a rejection letter initially from FD and they quoted to me the Limitation Act ruling and directed me to FOS. So I did as they asked and completetd the FOS forms. After waiting since February, I received a letter from FOS yesterdya stating that FD (HSBC) have decided they will uphold my claim and will contact me when they have calculated compensation. I think this will give hope to some people that have been put off by the Limitation ruling previously.
Bank of Scotland Loan - Letter from BOS beginning of June stating that they could not confirm how my loan was sold to me due to lack of evidence, so they will have to uphold. I am still awaiting an offer mind you!
Gateway Finance - Car Loan - I only had the loan for 1 year and sent templete letter. Initially got a rejection, but then went back to them again and they sent a cheque for £396.00, no argument.
Style Store Card - only taken in 2006 with a limit of £450, but sent letter to them in February and the PPi was placed back onto my account with no argument.
Now to the not so good:
Black Horse Loans taken over a number of years, last one in January 2002. Have had reject letetrs from them and have therefore decided to take court action. I received the Black Horse defence on Monday and looks like this one is going all the way. The above loans were in my name, however, the black horse is joint names and as stated above, my wife has been diabetic for a long time. They have again stated the limitation act in their defence document. I will keep you updated as to how this goes, but I am not too confident.

We recently received a letter back from the FOS also, to inform us they could not proceed with our loan ppi complaint with Endeavour either because these were not regulated until 2005, yet I did find out their link groups are and were regulated from 2001, so the way its going I will be trying to pursue through these.
However a friend of mine did mention about sending a SAR request to one of the credit associations such as Equifax, Experian etc, these will hold all information on you, accounts with all you've had with etc, you never know what may come back that will help you try to pursue your claim through other links.
Do you know who American Express may have had links with ?
Whoever they were linked with it may be worth pursuing through them where you may find they were regulated.;)

There is another thread to add this of reclaiming PPI, lots in the same situation where these amazing folks will give you the best possible help and advice they can give.;)
Right site, just slightly wrong thread......:D , don't worry Horace hun, the help here is amazing. You will feel lots better when you know there are other routes to try.

Just a quick one to say that thanks to the template letters and a little bit of creativity in changing some of the standard paragraphs, I have succesfully managed to get LLoyds TSB to cough up nearly £4K of PPI over 2 Loans.
They very cleaverly ignored my instruction not to include PPI in the consolidated 2nd loan and have managed to "lose" the paperwork that would have substantiated, or allowed them to defend my claim. After raising concerns that they had mislaid my paperwork they informed me that they only have to keep the paperwork for 3 years!!!
I would say that if you still have a loan and believe that your PPI policy was mis-sold it's well worth making a complaint. Some of the finer detail on the settlement is outstanding i.e how much they are going to take to pay back to the loan but all in all well worth writing the 2 letters. Good luck guyz!0 -

My wife took out a Personal Loan in June 2005. I have been trying to get her to reclaim for the past year, since reading this site. Eventually wore here down and sent in the stage 1 letter and after 6 weeks Barclays tried to fob us off. Sent in the second letter at the beginning of June and they paid the money into her account last week....
And with our 1st baby due in November it could not have come at a better time. :T
Being the sceptic I am I was hoping someone could offer some advice on the refund we received.
The letter sent by Barclays has refunded the ff:
PPI Premium - Paid to my wife
Insurance Rebate - Credited to her Personal Loan before settlement in June.
Interest Charged on PPI Premium - Paid to my wife
Statutory Interest 8% - Paid to my wife.
We have since settled her loan and moved it Halifax for a better interest rate, which has left me confused about the "Insurance Rebate" being credited to the loan before settlement.
I am considering asking Barclays for an explanation of this as I have a feeling that we should be receiving these funds???? The rebate was apparently £1,316.44 but the settlement figure did not seem to incorporate this amount.
Any advice will be much appreciated.....:rolleyes:0
