    Hi

Just to let you know, we lost in court today. The judge agreed with solicitiors that our claim was time barred as I would have known at the start that the insurance was of no use and I could have gone anywhere else for the loan. Judge said I was intelligent enough to know that I was being had and nothing had changed since I took the loan in November 2000 except that I have seen a tv programme and read some news article.

I would certainly advise caution on going to court if the claim is time barred, especially if you are in the least bit intelligent.

£415 down, but it was worth a shot. There is no justice in the world.

Sorry to hear you lost, I take it this was with Lloyds (seeing your signature). Dont give up on Lombard, I see you are awaiting a court date with them, did you go to the Ombudsmen first ? Im interested as I have Lombard and Lloyds PPI claim with them, waiting for an adjudicator for what seems forever.

    Just a quick update....

After sending three letters to DAF, I received yesterday in the post a cheque for £118 and a letter stating that the last 9 payments of our car were now cancelled and the car paid off in full. There was also a last line that stated if we are still unhappy that we can take this further to FOS. There was only the letter and the cheque in the envelope, not any forms to sign etc, which surprised me.

We were delighted with the outcome until we looked further at the fine details of how they calculated what they were going to pay and quite frankly we have been shortchanged in the end.

They refunded the last 9 carpayments but did NOT take off the 28.9% interest amount for those same payments that will now not accrue interest for the 9 months, so we still "paid" for them even tho not accumulated. They still charged us£563 for insurance for whatever reason.

The total refund if you add in the car payments and the 118.00 cheque they sent comes to less than £2000. When in fact the PPI that they owe us is actually just over £3k including 8% interest. I am happy that the car is paid off now, but not happy that I have still been robbed in a sense and still out of pocket by a grand and a bit!

My question is this... if it were you and they still owed you £1000 + would you turn this over to the FOS?

I think what they have done is still horrible and not right, also how can they charge interest on payment months that will never happen now?

Would appreciate any additional thoughts please :D

I can finally report my success!!! Barclays sent me a letter today saying that they uphold my claim!!! not a changing sum of money but still £ 686.00 better in my pocket than theirs!!!! i was hoping for a sum about £ 3000.00 but they refunded it earlier to my existing loan which i completely forgot but I am happy anyway,
it is a success for me.
Thank you Martin for all your help, this site is amazing!!!!!!
For those who doubt, please don't, keep going, you will get there in the end.

Claim against: HBOS - 2 loans

Initially got the "go away" letters so went to the FOS. On Friday 27th June I received a letter from the FOS stating that whilst HBOS were not accepting liability but would refund the cash as a gesture of good will - RESULT!

Will post again once I hear from HBOS.
    Debt in June-03 - £24,000
    Debt in June-06 - £8,500 (all on 0% cards)
    Debt in Jan-08 - £4,000 (all on 0% card)
    Savings greater than debt!
    Officially debt free!!! :j
  • Hi, after rejection letters from the coop bank re my mis-sold ppi, have just received a letter back for the fos after only 2 weeks having been looking at my complaint with a full and final settlement refunding all my ppi plus interest on each payment, also the pervious loans we had took out with ppi added are also being refunded plus interest at 8% which i did not even complain about, now a new loan is to be set up and they will use the money to reduce my existing loan, now my balance will be loads less and also reduce my payments and time left on loan - excellent!!! thanks Martin for template letters.

    Hi Everyone,
Following a succes with Lloyds tsb some months back have just heard from the FOS who have upheld two claims I have with them- one against the Halifax and one against Sainsburys bank- got the full PPI plus 8%! Am very happy- haven't worked out how much that is but will keep you posted when I hear. I got those acceptance forms back to the FOS pretty quick I can tell you!

Anyway, good luck to all and here's hoping you get the outcome you want too- I've one more to hear about so hopefully I can make that success number four!
Cheers too to the saint that is Martin!

Just got my letter from th FOS today for my claim against the Halifax HBOS. Not sure how much I will get back, but Halifax are paying as a good will gesture and not accepting any blame! But get the full premium, all the intrest paid monthly and also the 8% so I am over the moon. Just gor to get another £1000 in bank charges of HBOS and I'll be close to being Deft free !!!! Yippeee
Thanks so much to all Money Savers for their advice, and of Course to Martin, you are ALL STARS!!!!

I think I've had the same letter from the FOS regarding a Halifax loan.

Not admitting liability, but as a goodwill gesture they are refunding PPI, plus interest and 8% statutory interest.

First result - and its a good one! (if my calculations are correct)

    I'll update when I get the figures from Halifax :j :j :j :j
LBM November 2005: approx £32K
    Current debt: approx £12K :T
Getting there one day at a time ;)
  • I have received the same letter from the FOS saying HBOS is paying as a 'gesture of good will.' Not happy with having to wait 4-5 weeks for the payment, but after waiting six months I'm sure i can wait a bit longer.

Only 3 more cases to win against HBOS which are awaiting adjudication at the FOS and another 2 ( egg cc and northern rock loan) in the same position.

Its along wait but happy with the first result.sport-smiley-001.gif

Thanks to all the people who post on this site as reading them has definitely helped.:T

    Thanks :money:

The FOS must be clearing a glut of HBOS claims they have! (Mine's still outstanding!). A big well done to you fellow Halifax customers - I hope I'm joining you soon!
Almost debt-free, but certainly even with the Banks!
