PPI Reclaiming successes and failures

I spoke to a right arrogant *Banker* on the blower today:mad:, I rang capital one CC to ask them to reset my online password and make a payment, and the donkey on the phone decided to give me a lecture on the fact that i am over my limit by £21, before i even got a word in and thats why i cant access it (Im sure it was his first day on phones, he couldnt even string a sentence together). I found myself being stubborn to the point where i told him "thats 3 times you have asked me the same question" Are you ignorant?, You forget that I contacted you first, Im paying for the call, therefore this conversation is on my terms, its rude to speak over people!". (I actually called to make a payment, reset my password and find out if my letter was recieved). I refused to make a payment through him, so i called again, spoke to someone much more polite and lodged a complaint. Also the letter i sent on the 5th october ref ppi has not been recieved hmmmmmmm.
Can you stop the payments whilst claiming back PPI? Just something i read in this forum

Did you send your letter recorded delivery to them? There is a postal strike in some parts and things are taking ages (even recorded delivery items) to get through. I would give it more time.

Trisha - i have read on other forums of peoples credit files (is this the right term marshalka) being completely trashed by taking advice from people to stop paying - dont do it! There lives have turned to hell believing people telling them to go for unenforcable terms & to stop paying while account is in 'dispute' etc0

I am one of those who believe that you have to do what YOU feel is right sometimes.
In my case with Barclaycard, when they stopped listening to me, I cancelled my direct debit and then they listened. I did however refuse to pay them anything towards my balance "until such time as they resolve my complaint as filed with the FOS" so I missed 3 monthly payments.....BUT I INFORMED THEM OF MY ACTIONS before i withheld payment!! and they were in my view wrongly taking PPI installments from my account after I had asked them to stop.
I phoned them today to find out if my balance had been wiped and it hasnt yet, but my card has been cancelled and account closed due to "non-payment".
Spoke to a rep from barclaycard as I couldnt accesss my account online and got a rather terse reply from a "non indigenous UK employee" that as Iwas such a bad payer my account had been irretrievably closed and I would now be dealing with a debt collection agency.
Another phone call to a very nice rep based in the UK confirmed the above, but she had access to my ENTIRE file and even apologised for Barclaycard having been so slow in the matter (since Feb), instantly having had a look at the file, a 30 sec chat with her boss my account was re-instated just awaiting the balance to be wiped.
The long and the short of it is that without people who dont always manage their accounts absolutely perfectly to the last penny, those companies dont make a penny which is why they hate rate tarts etc.
The reason I stay with Barclaycard.....I can`t be bothered to change.
And as for the CR agencies, the nice lady told me that after a number of years of holding a card with the company, they never bother to report trangressions to the agencies.......anyone have any more info on this?0 -
Can it be true that companies choose which people they wish to report to the CR agencies?0

Well after 16 long drawn out months, I finally have the Ombudsman's final decision and they found in my favour against Nemo!!
I dont have the figures yet as only got the letter from FOS today but I think it will be in the region of £5500.

I finallly got my cheque on thursday (exactly 4 weeks to the date of the FOS ruling) total =£5652 !

I took out a loan with Norton finance and stressed to them that it would be reapid in five months. I took out a PPI which was recommeded but didn't realise that when I settled the loan I had to pay the total amount in full. I put in a complaint to the financail ombudsmen who have been fantastic, however I am approach two years of the claim being underway. They have upheld my claim but Norton appealed, Then due to them being so busy a senior adjudicator assessed the claim and again upheld it. Norton have again, appealed. It now has to go to the ombudsmen themselves so god knows how long thats going to take. I am in total about £7,000 out of pocket. Not sure if there is any way to speed things up, but the ombudsmen have been great and if I win my case, it will have been worth the wait purely out of principal. Fingers crossed.0
