  • Hi, I made a claim in 2016 to JDW for PPI. This was turned down and the Ombudsman upheld their decision.

    A few weeks ago on 15 April, after reading about the Plevin ruling, I decided to make a claim with regard to this. I went through Resolver. JDW did not reply and Resolver then sent me a message saying I could escalate this to the Ombudsman which I did.

    I still received nothing from JDW and didn't hear anything from the Ombudsman but 2 weeks later I received a letter from JDW talking about my PPI claim (not Plevin) and saying that although they did not agree my PPI was mis-sold Allianz (the underwriter of the policy at the time) upheld my claim. To cut it short, as a consequence, they sent me a cheque for £11,946.06. To say I was shocked (although delighted) is an understatement.

    My message to everybody out there who has been turned down by JDW is :jfile a Plevin Rule claim through Resolver and sit back and wait. It was worth it for me. Good luck everybody and would be delighted to hear of any successes.

    Even better - submit a complaint NOT via Resolver, but directly instead.

    The clock is ticking and people may no longer have the luxury of Resolver slowing down or mislaying their complaint.

    What were you reclaiming: - A Bank Loan from 2001

    Who was the provider: Bank Of Scotland

    How much did you get back: £4,321 - used the resolver letter on here and got a letter from the bank 7 weeks later with the details - no fuss, took about 5 minutes to complete totally gobsmacked!! - Have done the same for old credit cards as well!!

    Did you get it back after a letter or did you go to the Financial Ombudsman: On-line enquiry with supporting information plus one telephone call.

    Have been banking with Barclays for over 30 years! Tonnes of credit and loans for both business and personal.
    To be fair I've found them to be very fair!

    I had PPI on my first ever credit card from 1996-2004. The claim was upheld at the 8 week mark but, was estimated and based on average calculations (which I completely understand as it was some time ago).
    The redress was based on a £1500 credit limit. My limit was £4,500 and maxed out from 1998 as I used it partly to fund my wedding.
    Barclaycard have said they would be happy to recalculate the amount if I can provide further evidence of the premiums paid.
    Should the amount be lower than the first redress they will not require me to repay the money. This is extremely decent I have to say.

    I am more than happy to put the legwork in and have received my bank statements via a SAR and have requested the Barclaycard statements also.

    Will post again if I am fortunate enough to receive a further refund.:):):)

    I'm not sure why you think "legwork" involving asking the Bank to provide evidence they have already said they don't have will be in any way fruitful?????
  • Apologies if I haven't written that correctly....I just wanted to share my experience.

    They say they don't have a record of the premiums paid, just the dates and explained. However, when I spoke to Barclaycard by telephone they asked me to submit a GDPR request and have confirmed they are mailing statements from 1998-2004.
    I also received a letter to explain they estimated the redress as they had gone over the 8 week time frame.
    I have already received my bank statements from that time with the payments on so have begun to compile a spreadsheet.

  • I have been with Lloyds bank over thirty years and with the deadline looming recently enquired about PPi
    I filled out the online form of basic info and addresses, and did not send back the questionnaire sent to me. The search found I had 8 Loans between 1997-2011, 3 of which had ppi on them, resulting in a pay out of £6000 including Interest at the end of may 2019.
    I thought that i have always turned down insurance associated with banking products. So this must have been added without my consent or knowledge. I was quite Gobsmacked. Lloyds bank have earn a lot out of me as a customer, with premium accounts and interest etc, so it was very satisfying to achieve this unexpected Success of moneys that were taken underhandedly.
    I would urge anybody who has had financial dealings with one of the big banks to enquire about possible mis-selling asap.
    I would like to thank MSE for all their advice, also LTSB for the apology and making the process easy.
  • Success - we have just rec’d £432 from Northern Rock from a loan we’d had with them

    Failures- we have been turned down by Halifax re PPI we had on a mortgage with them, they say’ there is no evidence that we weren’t given all the correct information at the time of sale and that we agreed with the purchase’ - how do they know this unless there is a transcript of our conversation from back in the 1900’s ? We hadn’t heard of ppi until recently so cant believe that we consciously agreed to something that was an extra optional payment that we didn’t need

    Second failure - credit card with MBNA - they say ‘they are satisfied that we agreed to taking this out during a telephone conversation to take out the card? And that it was on our statement.’ Also we told them that we didn’t need ppi and in th event of one of us being made redundant and unable to pay our bill family members would have helped out. Again have no recollection of agreeing to this, then they said that they weren’t satisfied that family members could have covered our debt! How on earth could they assume that !
    We intend to go to the ombudsman but anyone with the same outcome who has any advise on how to proceed would be very welcome, thanks.

    With mortgages there is a Fact Find and a "needs and wants" document. Your signature on this documentation will be enough for the bank to have evidence that you were indeed informed of the insurance and agreed to it.
    You really can't complain about PPI because you have forgotten agreeing to it. Your memory is trumped by signed documents I'm afraid and even if you signed without reading then you should have queried the separate PPI payment coming out of your Bank account each month.

    MPPI covers your mortgage payments and does not suffer from the same generic mis-selling faults as loan and credit card PPI. You can still purchase MPPI today. In what way did you show that you did not need the insurance? How would you have paid your mortgage if you were made redundant?

    I doubt you'll get this overturned based on what you have said..

    Banks (and the Ombudsman) will not uphold a PPI complaint which relies on relatives being called upon to help out in the event of redundancy. I assure you that the "assumption" is that your relatives would not be able to afford to bail you out and that they wouldn't have to if you had PPI. The Bank are also correct to point out that your statements would have had PPI itemised on a separate line each month.

    Of course you have that right, but your insurance does not appear to have been mis-sold.

    Even your "success" with Northern Rock sounds like an auto-payment or commission refund.

    Had checked credit cards for ppl and found nothing. One loan which specified no insurance premium. Watching Martin on his PPI programme months ago thought about closed Goldfish account. Found account number and dates, etc and used Martins link to make online claim. Couple of weeks later had ack and 2 months later had cheque for just over £500. Thought it didn’t affect me so lovely surprise, firstly how easy it was and then an added bonus of money. Thank you.
