    They would have written off part of the debt when they agreed a setlement figure, so they're just taking what he owes back.

    If you want to get into morally wrong, is it morally wrong to borrow money and then not pay it back or is that ok?

  • Recieved a cheque for £957 from Bank of Scotland Mastercard, following a PPI reclaim.
    Form was very simple to fill in, and all I had was the account number !

    Have tried another claim against a store card, sold by GE Capital Bank Ltd, now run/owned by Santander. Got a refusal letter dated 24 hours after their letter of acknowledge! Now passing the claim onto the Ombudsman
  • I used a ppi claim back company and asked them to claim against my first 2 loans which I've now won but my bank phoned me while processing my claim and said do you want to claim against your 3rd, 4th and 5th loan and my credit cards. Which I said yes to so my percentage payment should it be based on the wins on the first 2? not all of them? can someone help me out.

    You will have to check your contract with the claims company but they usually take money off you for any future successful complaint as well.

  • I contacted MBNA & HFC (formerly Marbles) for credit card PPI refunds. Both forms were filled in exactly the same as all circumstances were identical. MBNA have upheld the complaint & advised of refund which I am happy with. HFC have told me they are unable to uphold the complaint & have offered a goodwill payment. Can someone tell me how one company can agree the complaint & another will not when all things are the same. HFC PPI charges are from 2003 - 2005 & letter says that interest is accrued to Feb 2010 but I'm not sure if I'm working things out correctly as the refunded interest does not look enough. Is this because as they have not upheld the complaint they do not have to abide by the FSA refund guidelines? thanks alot,

    Yes, it is because they are offering a goodwill gesture.

    Different companies have different selling techniques, some will auto uphold, it depends on how you originally bought it.

  • Payment Protection Insurance is AN insurance cowl that sees thereto that your loans are paid, within the event of you changing into idle, invalid and even covers death. But, there is additional thereto than what meets the attention.

    I would have thought that if the reduced settlement figure was a "full and final " how can they then take the surplus back? if the PPI was mis sold then it should not have been included in the settlement figure anyway, and in my opinion, why should they then be able to take this back now?.

    The whole PPI amount would still have been on the loan balance even when the loan defaulted, so the bank has it both ways, had they removed the whole PPI from the loan balance at the point of settlement, this would have reduced the amount of the "wrote off " amount.
    It seems to me that the OP has then paid for the whole PPI twice, if this is not taken off.

    It may be worthwhile contacting the bank and asking if they actually took the whole PPI amount off the balance when doing the calculations as to the amount written off that they are taking back.

    You are right, you give a claims co carte blanche to do all claims on your behalf, win win for them for so little effort.
