PPI Reclaiming successes and failures

    Another success from HSBC:
    £3950 for three mis-sold loans. They exceeded the eight-week limit to respond to the complaint, but paid up pretty quickly after we accepted the offer.

    Running total now is just under £8k reclaimed across five loans from HSBC and HFC - which is very helpful to our situation indeed :j

    We still have one complaint outstanding with HSBC, due to a disagreement about the evidence (they've accepted it's a mis-sell and upheld the complaint, just won't provide redress).

    We plan to refer it to the Ombudsman, although after 1 April DH is going to phone HSBC to give them another chance to make an offer - we've worked out the redress would be just under £500, which is rather less than the £850 Ombudsman fees they'll now have to pay, just for the case being referred to them, never mind whether we win or lose. Not feeling too hopeful but it's worth a go!

    CAn I ask what the reasons were you gave them? I have 5 cases with them at present 3 loans and 2 credit cards. Thank you

    After very nice wins with HSBC and two with MBNA (just awaiting figure on the loan settlement), RBS has rejected my complaint for a credit card claim, stating I had taken out the PPI with all the facts via a postal application, therefore it was a non advised sale etc, and the terms and conditions posted to me set out what it covered.

    They sent me a very comprehensive reply and stated they had enlcosed a copy of my orginal application, statements and terms and conditions. However out of these three documents, the copy of my original application is missing.... needless to say I have written to them to ask for this.

    Has anyone else had experience of missing documents etc? I am assuming it is just an error on their part.

    when I first wrote to them they said they had no details of me on their system, despite a copy of a statement and the account number on the questionaire.

    I was quite tempted to reply saying if they had no record of me, I wouldn't have to pay the remainder of my bill!
  • In the course of helping my sister with her finances (following the sudden death of my niece) I have discovered she had been paying PPI on just about EVERYTHING!

    We have just had a success with Lloyds TSB loan (£10,000+) and we are claiming on the TSB credit card at the moment.

    We put a claim in for the Santander Evans storecard and have received a rejection on the grounds that she was supplied with the paperwork "30 day no quibble guarantee" and it was up to her to reject it or it was taken that it was an acceptance.

    My point is, as we explained to the company, that I believe it was sold as a compulsory feature of the card. At no time was it made clear she could "opt out" and keep the card. Have the card, with insurance, or not at all which if I understand it correctly is "misselling"? I need to request copies of the agreements as we can't find them and my sister does not recall receiving them or signing anything.

    The letter also refers us to complain to the Finance Leasing Association not the Ombudsman. Is this correct? Do I go back to them once more or go straight to a higher authority?

    Any advice? Anyone else had "issues" with Santander/Evans?

    Our adjudicator at the FOS is upholding our complaint against Central Trust. They are writing to central trust this afternoon and they have 14 days to respond.

    Fingers crossed at least we have won round one :p:p;)

    I wonder just how many people they have successfully fobbed off with the "we uphold your mis-selling complaint, but have no records of payment" excuse?

    @manama Various reasons - all were advised sales (ie done face to face in the branch or over the phone) and in each case we were told that the PPI was compulsory.
    Also, for four of them:
    - OH or myself in temporary employment and would not have been able to claim
    - OH had two pre-existing conditions that would have excluded him from making a claim

    For the other:
    - already had adequate cover in place through work sickness benefits

    after numerous phone calls ( which i feel are a total waste of time as they will just not tell you whats going on !! ) very frustrating after having to be on the line for 15/30 mins :mad: !!

    anybody else came across this situation ?
    We have too!!! Hubby's 13 weeks today,after 35 years with Lloyds, they keep saying "under investigation". I'll keep an eye out for your updates and I'll post his.

    Hi,

    Had success with halifax, they have agreed to pay me back £310 however i have a trust deed in which my final payment is due next week, Halifax have said that they will pay my refund directly to the trustee, does anyone know if i can ask to have the refund paid directly to me?
