I feel very let down by Lloyds and feel Im being penalised when all I was doing was being truthfull!!
Does this mean I dont have a case, and how are so many other people having successes, Im obviously not the only person who has listed that they felt pressured into taking the policy or the only person that was told that it wasnt optional!!
    Remember, I'm not your bank.
Unfortunately, your only recourse is now to ask the FOS to adjudicate. This will take many months.

Claimed on a Egg Loan from 2000, very easy to claim, followed advice on this website.

Egg wrote straight back saying would look into my claim.

Have had a letter today saying claim upheld and would within 2 weeks be refunded to me with interest on the premiums plus 8%.
A big thank you to the site.

hey thanks for the reply , been in touch with FOS and on lady said they have never heard of this and surly somthing should happen to them because it was their error , she put me through to someone else and i have to wait for natwest to send the break down they say they have re-done ( they have never sent letters ive wanted and im sure because we now owe them this will be sent fast :(:mad:) anyway the guy i spoke too confused me he said they can ask for it back because a goodwill payment is not a binding contract and they could well have over paid me but again heard nothing like this. If its not a binding contract surly because they have messed be about for so long i can just say well thats your fault not mine so tuff :)

You need to know what the original gesture was for, if they made you goodwill offer then, why is the gesture £3,000 down now, what have they found out that made them reduce the offer by so much.
You need to ask these questions.

If you have to pay the amount back, then I would do an income and expenditure and offer them a small amount each week, also put a complaint into the bank and the FOS, explain that you now owe money (this is another debt) for an error on the banks part, they offered a goodwill gesture that you accepted only to be told later that they were wrong and that they overpaid you, had you known the gesture was wrong you would have queried this with the bank, this may not get you anywhere but you could try.

Because its a broker and not firstplus direct and the loan was taken out in May 2003, to me it seems likely that CT Capital will go down the root of it being over the 6 year time scale and they will reject my compliant, anyone agree.

They may say "get lost" due to the year it was taken out, wait and see what response you get from them first, they may uphold, if they do not then you need to find out who the Insurer was and put the complaint into them.

Give CT a chance to respond first, people have won mis sell on this forum for PPI from the 90s so forget the 6 year rule.

Im no financial expert but it seems pretty obvious that they will use the "Time Barred" excuse as a rejection as they were not regulated prior to 2005 so basically i aint got a leg to stand on, or have i even if they do this?

Recently sent in 2 lloyds tsb credit card ppi reclaim forms to be told they cant find any records of me paying any ppi on both credit cards !! cards date back to 2005 ..

but luckily have all my statements from all my transactions , and all the payment protection charges they took out every month .. so have scanned and emailed all relevent pages to there office in wales ..

after numerous phone calls ( which i feel are a total waste of time as they will just not tell you whats going on !! ) very frustrating after having to be on the line for 15/30 mins  !!

approaching the 12 week period that they say they will deal with matter .. but still nothing ......

after banking with lloyds for over 20 years , this will be my last ..

anybody else came across this situation ?

Like you I have been with Lloyds for almost 20 years and they PPId me to the hilt even on my overdraft! I consider myself one of their best customers
Lloyds are very frustrating to deal with, they make it up as they go along.
I assume that they acknowledged receipt of your email with your statements? Don't forget that Lloyds were the number one PPI perpetrators!!
Very important to remain positive armed with a little patience.
Best of luck and lupdate us on your progress :-)

It is possible that they can do this, but the Insurer would have been a member of GISC, this means you can go the Insurer route and if you do then the Insurer says no, the FOS will go after the Insurer, they have a test case at the moment for going down the Insurer/underwriter route, it is possible that they may win this case, if they do then you will be able to get redress.

Wait and see what response you get first as until then it is just guesswork.

    Hi Andy

Hopefully you will hear something soon, and it appears as they were well overloaded with one of the highest ppi complaints, they are still behind, but they should let you know where you are and keep you updated.

Did they actually confirm you will hear by 12 weeks?
If this time have been and gone, get your local MP to chase this up for you, they should be willing to help and write/contact on your behalf.

Hope you hear some good news soon, fingers crossed.
