PPI Reclaiming successes and failures

The whole process has been fairly simple and easy enough to complete. Always worth having a look at any old cards or loans, always a chance you've been paying PPI. Also realised I was paying it on a MBNA card that closed a few years ago, so starting the process to make a claim on that as well :j
Hey Chimo
I sent my first claim by recorded delivery on 22 Feb to MBNA and have not yet heard anything from them. I am reclaiming credit card charges and am about to send them another letter to reclaim PPI.
Would you mind posting an update on here when you hear from MBNA?

NRAM wrote to me three weeks ago. I phoned them back with my reasons on why I believed it was a mis sell. Yesterdy came home to a letter upholding my claim. Returning ppi plus 8%simple interest.just over 1000 coming back.
Well done to them as I was told I would not hear anything or 16 weeks! :j:T:T:j0 -
Is this a mis sell complaint or a Sar?.I have a claim again barclaycard was egg for mis sold ppi on a credit card. I called for an update on several occasions and it is always the same response that it's up to day blah blah of 40 and that they will respond by 16 th march...has anyone else received there final response before the 40 days are up or does it seem likely that at day 40 I will receive an automatic rejection letter
It is 8 weeks, this is 56 days for them to give a final decision for a claim for mis sell.
It is Sar request that they have 40 days to give you this info.0 -
Over the years I had had 4 loans with Welcome finance, I got in touch with them aboout the PPI on all the loans.. they said that they could not look at 3 of them as they were before 2004. They did give me over £1200 back within weeks, stating this was because they could not prove that I had been miss sold the insurance. They gave me the contact address and number for Aviva Insurance as they were the company held responsible before 2004. I wrote them a letter just stating as above that Welcome had told me to contact them as before 2004. I had a letter accepting recieving the letter. Then today I had a letter from them saying that although they admitted being responsible for the insurance and " I was one of a small number of customers who had recieved a misprinted insurance document that stated that Welcome Finance were acting as our agents in relation to insurance " they also say that if I had made a claim it would have been honoured as I was covered by the policy.
It then goes on to say that.. they had asked Welcome for a copy of the loan agreement, which they could not provide due to passage of time.. but that they did provide a specimen document !! Then states that because I was within age range of the cover and employed then I was "clearly eligible for the loan cover " And no reason to suspect that the policy was unsuitable for my needs...!!
Considering they have only seen a specimen agreement..They state that "I was provided with the policy terms and conditons as YOU signed the loan document to confirm the leaflets had been provided " Also they say I was given a copy of the insurance and also told about the cooling period.
So, they could not uphold the complaint as they were not satisfied it was mis-sold or unsuitable to my needs at that time..
All of this based on a letter I sent stating I was making a compliant...they never asked about what happened, never sent me a questionare, never asked for my side.. just went ahead and concluded. I called them on reciept of the letter and spoke to "Matt" who told me that at the end of the day I had a choice to sign or not to sign and as only 2 people in the room and they would never know the conversation.. !!!!
What strikes me most is that the reason that Welcome upheld the complaint and paid out is the very reason Aviva is not paying out ... any advice guys, I have already set wheels in motion with FOS. But surely, this is wrong guys ?? Oh and at the time my work covered me for being of with sickness on full pay for 6 months and then at a slightly reduced rate also fully covered for redundancy as well, which the sales person was aware of as I kept telling him he just moreor less implied that I would get the loans more favourably if I signed the insurance as well ...
Write back to them and reject their decision, tell them this ppi was front loaded ppi, in effect a loan upon the loan that was paid back over the term with interest, tell them you were covered in case of sickness and if you have life insurance then put this too.
Ask them to reconsider your claim or you will take this to the FOS as front loaded ppi is one of the most upheld of all ppi mis sell claims by the Ombudsman.
Let me know what they say.0 -

Oh they are naughty on my last call they said we've received the original application and it's just waiting to be processed to the next stage and it's day blah de blah so by day 40. I keep telling them each time I call that other financial institutions have responded by now. My gut feeling is that it won't be good news
Hi
I too was in the same position claiming from Barclaycard for an Egg cc. Date they had to reply had passed and heard nothing. I emailed CEO and received a reply for this about a week later saying it wasn't being upheld as they couldn't find policy!! If I had any paperwork they would have another look (I don't have original paperwork) but I could take to FOS if not happy. Haven't had time but will SAR.
Barclaycard seem to be good for stalling as also having trouble getting an answer for Barclaycard CC (have policy for this one). Have emailed CEO 2/3 times but had no reply!!! Appalling customer service.
Good luck with your claim0 -
Hi all,
Just thought I'd fill you in on an offer I have received,
Loan was taken in 2004 and repaid in 2010.
1st claim was rejected and I didn't follow through to Ombudsman as I had operational commitments being in the MOD.
Thought I'd have another go at it following the court case.
Rang AA Finance PPI number and they took my details, 1st letter said they are looking into my case.
2nd letter offering £5388. Premium + 8%
All following 1 phone call. It has taken 6 weeks.
Well chuffed.0 -

Will do. I'm sending the request for the original paperwork this morning, so I'll let you know when (or if ) I get a reply.0 -
