    End of August does not apply to claims with FOS

    For a yardstick, I started my RBS claim in September 2009, had FOS letter stating RBS are willing to settle last month and signed, but still waiting on actual figures/payout

    My claim was rejected by RBS, then rejected by the FOS adjudicator so I appealed to FOS Ombudsman, it was then placed on hold whilst the JR was in swing


    Has your CMC told you what stage the FOS enquiry is at?

    (Adjudicator/Ombudsman)

    General accepted situation is any claim sent to FOS at the moment is taking roughly a year for FOS to get processed - FOS have written to CMC's stating as much - this would be no different if you were complaining on your own behalf

    Hi Tifosi,i was under the impression that if the bank made an offer the FOS have to pass this info on to you to accept or decline? so people may not have to wait until eternity to get this back,especially if the bank has the deadlines for older claims.

    RBS did not give a final response by the October JR request. I was then put on hold. I have joint loans with my partner and in June an FOS adjudicator asked her to sign to say that she was also complaining. That was last I heard.

    Hi,

    yes, as said above thats what happened with me -

    The FOS passed me the banks offer (but did not have amounts included) and asked me to sign

    I signed (under the understanding I could go back to them if I didnt agree with the banks figures once advised) and scanned/emailed the form back to FOS, they then sent the scan to the bank immediately

    However, FOS are still allowing the banks (RBS) another 8 weeks to calculate the figures and pay up!

    Its luck of the draw really, you may get lucky and the bank (RBS or whoever) may offer to settle ("for expediancy") or they may let it drag through FOS - whole things utterly random rather than based on details of the complaint

    In some ways I wouldvve preferred it to stay with FOS so I got an ombudsman decision, that way at least I could go to court on it if they didnt pay up within 14 days

    Well, based on the start date of your complaint I hate to say it but would imagine you may have some way to go yet

    You have to allow for the fact FOS are dealing with literally 1,000's of complaints a week at the moment (Year ending 31st March 11' = 104,597) and that figure is increasing week on week

    Whilst the banks are being their usual uncoperative selves ........


    I can totally sympathise with your frustration having not received my payout some 20 months after starting but we dont have much choice but to grin and bear it as the regulators (FSA and FOS seem incapable of handing out tough penalties (as opposed to financial penalties the banks can just write off against tax loss/gains created by the number of people that give up on their PPI complaints)

    Classic example is I asked FOS to chase RBS on my calculation figure 2 weeks ago, emailed yesterday only to be told FOS are still waiting on a response - this kind of delay and attitude should be dealt with swiftly to set an example, but its not

    I thought that the agreement was that the banks had up to end of August to respond to ALL
    Claims submitted prior to April 24. Surely that must include claims that are with FOS? I appreciate that a backlog exists at FOS but surely people should not be time punished for following the steps laid out by law if a bank did not respond in their initial 8 weeks time limit?
