I think in most cases the confusion relating to the time barring is that it is supposed to be any financial product that was repaid within the last 6 years rather than the start date of it being within the last 6 years.
So if you had a loan that started in 1995 and was repaid in late 2005 (ie within 6 years ago), the institutions are more than happy to repay to the start date of the loan.
This is a grey area and some lenders are using this confusion to their advantage.
Some lenders are repaing PPI even on agreements that finished longer than 6 years ago, to try and keep valued customers.
May have a little light on 6 year time barring etc
The Limitation Act offers any long-stop mechanism so that if you concealed the facts one year ago then you do not merely accrue an additional year of liability. I think that a single instance of concealment invokes s.32 and the limitation barrier falls away completely.
Concealment amounts to a question of the morality of the defendant's action. Once this is established then I do not believe that the courts will strive to give them any help.
I understand this is also confirmed by case-law.
In fact it seems even if a concealment has occurred even after the breach in question has occurred, the limitation period still falls away.
If the banks want to challenge this then it is up to the claimant to respond at least with the arguments above and then if the bank want to rebut this, they can rebut it with a statement of truth.
I doubt whether any of them would dare. They are already getting in too deep as it is.
A statement of truth which is made knowing that it is false or reckless as to its truth is a contempt of court. I do not believe that the banks would go this far.

trying to reclaim ppi from yorkshire bank. They sent a letter 4 weeks ago saying they would be in touch over the next 4 weeks however that period has now elapsed and no word from them. How long should I give them? Should I be bombarding them with e/snail mail?

I received a reply back the next day saying a letter had been sent out on the 12th July, which I then received exactly 7 days later, askign for another 4 weeks, which giving them even 6/8 weeks will be better than 18 months with FOS, unless of course they reject your complaint.

Hello, yes i emailed them through santander website. Yes i had my account number,thats all:j This was from a loan from March 1999 then another loan from September 2000.
