thank you moneysaving expert i have today recieved a letter from my tesco's credit card offering me £6218.00.they are going to pay off my credit card i wasn't offered a cheque this time i wondered if this the norm or should i ask for a cheque ?:beer::T

do you mind me asking how long ago you took the card and what sort of balance you had?
Just sussing out how they work out their settlements - £6218 is quite a generous payment!

I would contact then and ask them about this, tell them there is information missing.
I understand if the accounts are closed/settled, and that over 5 years they are not obliged to keep these, but if they sent you a copy of the original, then surely there should have been some info in relation to the account enclosed.
I would contact them, or maybe contact the Information Commissioners Office (ICO) by ringing them for the quickest way of this being dealt with and see what they have to say about this.

The accounts are till active, just set up a long time ago...the copy of the agreement was just a standard set of terms and conditions, could have been from any account...
There is absolutely nothing with a signature on it..I will take your advice and contact Commissioners office,:A

what did you do to get the copy, a S87/88 request for the credit agreement?
If so, you should send them a full SAR requesting EVERYTHING they hold on your account and person, this will confirm whether or not they have the original signed docs
If they dont have the original signed doc with prescribed terms of the CCA 1974, as the card was taken out before April 2007 they cannot enforce the agreement in court

Thank for responding...I have sent a SAR offf now, but seems like the original might be lost, the addres was wrong for a start!! ( Little eager with the cut and paste keys, perhaps?:rotfl:)
If it cannot be enforced, what does that mean, exactly?
