    It may be different for different banks but my ppi cc reclaim originally went onto my cc to bring the balance down, and then 3 days later they reversed it without telling me and when i called them to ask what had happened they said they had to pay me by cheque instead so i benefitted from it,

    So as i said it may not be the same for all banks but just be aware xx

    I would contact then and ask them about this, tell them there is information missing.

    I understand if the accounts are closed/settled, and that over 5 years they are not obliged to keep these, but if they sent you a copy of the original, then surely there should have been some info in relation to the account enclosed.
    I would contact them, or maybe contact the Information Commissioners Office (ICO) by ringing them for the quickest way of this being dealt with and see what they have to say about this.

    You can INSIST its paid direct to you by cheque

    They are allowed to pay off any arrears you may have on the CC and then pay you the remainder, but they cant just apply the £6218 to the balance (unless you request that, or you have £6218 of arrears!)

    Hi CB,

    what did you do to get the copy, a S87/88 request for the credit agreement?

    If so, you should send them a full SAR requesting EVERYTHING they hold on your account and person, this will confirm whether or not they have the original signed docs

    If they dont have the original signed doc with prescribed terms of the CCA 1974, as the card was taken out before April 2007 they cannot enforce the agreement in court

    Thank you again for all the help on the site, I keep finding more bits of info on here I never knew and really appreciate those in the know helping people like me!

    So... I got back from holiday this morning to a lovely letter from Halifax regarding a loan going back to 1997 and one from 2000, they have upheld both, though they were in the queue since November so it took a while. Got back £3500 which is twice what I was expecting so am really pleased! Wasn't sure if they would go back that far, and it took many phonecalls and letters but they finally agreed.
    Only one more to hear from, Marbles, and they are being really slow in responding for some reason, fingers crossed I may hear soon!
