PPI Reclaiming successes and failures

I feel really sad!
I took out a £5000 personal loan in January 2007 with HSBC. They quoted me for a 'fully protected' loan with repayments of £153 pcm.
I queried this as I was quoted less online but had to call a 0845 number to 'complete' my application.
I was told that I didn't have sufficient means of repayment if I was out of work or sick and that the loan included PPI. They explained it to me and I said thanks but no thanks, I do not want insurance.
They then told me that it was compulsory if I couldn't prove I could pay back the loan if I fell out of work. I said why would I need a loan if I have £5k sat in savings? Long story short they said they would reject my application unless I agreed to PPI. Which I did.
After reading on this site about the mis-selling of PPI and how many have reclaimed I set about contacting HSBC. After 9 months of letter after letter telling me I was in a back log I got a call from their claims handler saying my case had been assigned to them and they asked me a few questions. THE NEXT DAY!! I received a letter from HSBC saying they were rejecting my claim. I appealed this and waited another week for their final reply which low and behold was a rejection.
I then went to the FOS and after a few weeks they called me and asked me a few questions, they then sent a letter which arrived THE NEXT DAY saying that they agreed with HSBC because I had signed the PPI form. Despite me telling them time and time again in my letter and form that HSBC told me that I had to have it and that it was not optional they still agreed with HSBC. I have now forwarded my complaint to an ombudsman instead of an adjudicator but I am not holding my breath.
This was an extremely stressful experience and I have lost all faith in human kindness and justice. FOS took HSBC's side almost instantly and now I will finish paying my loan off having given HSBC almost £2000 more than was necessary and I'm left with a bitter taste in my mouth every time I see a 'success' story where the circumstances are the same as mine!

So sorry to hear this, wonder if the phone recordings were kept on these?
Just a thought but did you try asking for the recordings from when this was sold to you?
It helped one of my cases, if it wasn't for that then maybe I would not have been so lucky, but on another note did you actually request for all data accounts in relation to this loan, this is called a Subject Access Request (SAR), where they have 40 calendar days to comply, you enclose £10 cheque or postal order, for this request, and there is a letter template here.

Hi, there were indeed recordings and I have asked for them on numerous occasions however HSBC keep saying that because they rejected my claim they see no relevance in obtaining these recordings and now it is with FOS that FOS need to request them.
Everytime they seem to say that the recordings would most likely have been deleted by now.
It's a really frustrating situation because I didn't want the PPI and was forced to take it but HSBC and FOS are both saying that I wasn't forced because I signed the form! I just keep going around in circles with these creeps.0 -
Hi dalc87, ring whoever is dealing with your case at fos, and use this argument
"if hsbc are adamant that you were not mis sold and they have the recording of you accepting the ppi and you know you did not accept this"
then you want the onus put on hsbc to prove the conversation or you want your claim upheld as it is their word against yours. This may work but if it does not then you are no worse off by trying this.0 -

I totally agree with amersall here, and if your having any trouble with them holding back on the recordings, you could contact the Information Commissioners Office (ICO) for some advice on this, tell them due to the delay of the recordings, you have lost your case via FOS and want to continue.

Since my last post I have been in contact with Tesco personal finance and they tell me they are conducting an investigation regarding the treatment i received during my ppi claim.I was a little surprised by this and at the time i did not ask if i would be notified of the outcome of the investigation. Has anyone one else heard of this happening?0

I have a similar case with Lloyds regarding credit card PPI, I referred the matter to the FOS last August and received word back last week that they are going to uphold my complaint. With you having had first hand experience of dealings with Lloyds, what can I expect to happen now?

I hope that you don't experience being messed about by LTSB, but I won't hold my breath. The FOS 1st upheld my complaint in May 09, this was ignored by Lloyds until the Sept when they sent some more info that had to be looked into. It was upheld again, by a different adjudicator in March 2010, again Lloyds disputed that it had been mis-sold so it was put in the queue for an ombudsman. I was then lucky enough to be told by the FOS in September that mine was in a group that Lloyds had agreed to pay out, although they still disagreed with the FOS decision.
Then came the review, I hadn't had anything in writing from Lloyds confirming that they were going to pay out. Contacted the FOS and they confirmed that I would receive the compensation and the £200 awarded in May 08 for distress and inconvenience.
The first correspondence I had from Lloyds, since going to the FOS, was a letter in Jan with the figures, well layed out and easy to understand, going back to 1999, when I 1st had the PPI.
There was no mention of the £200, so I called Lloyds and they said that because they did not uphold and agree with the FOS, they would not be paying it, and to take it up with the FOS.
I phoned the adjudicator that I had been dealing with and he said he would email Lloyds, but if he didn't get a satisfactory result that even this part could go to an Ombudsman. This was Friday, on Monday I received a call from Lloyds asking me how I wanted the £200 paid and I received a cheque a few days later.
I hope I haven't bored you with my story and that yours is going to be straightforward and QUICK.
