    Hi, I am new to this so I apologise if this isnt the right place to put a question. I am looking for successes with Marks and Spencer, both the Personal Reserve account and their credit card. I have had both since the 90s. I am having a difficult time with them in respect of claiming PPI on both. On the Personal reserve (taken out in 1996) they simply state that M&S was unregulated intermediary for the sale of PPI and not a bank or member of the GISC. They efer me to FOS.
    The credit card goes back further than this one by a couple of years but it will be the same company I assume although I cant find details.
    Any positive feedback on others successes with spur me on I am sure as the rest of this site has.

    ps I have scored against RBS on A Visa card with Nat West £4,300 accepted (although to be honest I think the total was far more, but was happy to get this)

    Have u tried the insurer of your PPI or otherwise best going to FOS

    Hi and welcome

    First of all well done on your successes:beer:

    Now with the other as they were not regulated, the Financial ombudsman service (FOS) are not able to investigate, but they may suggest you try to make the reclaim with the actual insurer/underwriter instead.
    The FOS are able to investigate against the insurer as they had to be regulated.

    And Also the FOS are suggesting this direction to people in the same situation as yourself, I am one of them too, even though the insurer will possibly say no, the FOS will investigate, and they are also trying to make them liable, cos remember when your policy was set up, the insurer/underwriter are the ones who gives the approval.

    So give the FOS a ring, explain your situation, and then check on who the insurer was at the time you taken yours out, the lender should be able to confirm and send you any policy details of the insurer.

    Thanks very much for this. I have just written them another letter to say they did not provide the details as originally requested and also suggesting that I do not believe that have thogoughly investigated my claim.
    Its interesting that they refer me to FOS as by following advice onthis site I didnt think that was an option. Luckily I do still have the original document on the Personal Reserve and the insurers are Cornhill Insurance who surely must have been regulated??? so I wil write to them first, expecting a rejection but I assume that gives me more ammunition to go to FOS

    I really appreciate your help, will let you know what happens.

    I also have claims agains Santander who have been really bad, but will use another thread for that, if I can find out how to!!!

    Your very welcome.

    Well it seems you do have everything under control, and yes if you want to continue to pursue the insurer first, that if fine, at least them you can inform the FOS you have already tried that avenue too.;)
    And yes I would certainly think all insurers would have had to be regulated, so no problems there either.

    You have not got to start a new thread for the other if you don't want to, but if you do then stay obviously on this PPI reclaiming thread and you will see Start a new thread on top left of the forum, but otherwise your still okay here.

    I am not sure how you complained to the other but now the FOS have issued Questionnaires for customers to use to make a reclaim, you complete, save a copy for your records, and/or in case you need to refer to it at a later date.
    And send to whom is responsible for setting up your policy, and as usual they have 8 weeks in full to respond.

    These are used instead of letters.;)

    However, if you prefer to write a letter that is up to you of course, you can do both if you want to, such as complete the questionnaire and write a cover letter if you feel you want to give further information.

    The questionnaire is in replacement of the first template letter, but there are follow on letters on the above link if you need to use them later.

    Hi guys

    I had a letter last week from HSBC, one line rejeteding my complaint about PPI miss sale on credit card and flexi loan.

    And 3 pages explaining why they saying no.

    I have written back and to date not received a reply as they state the person who did my complaint has now left the bank. as part of there explanation they do say they dont hold any records of the sale, but state what should happen.

    And asked why i had never mentioned a missale in all these years ( accounts opened 2000), it also contradicts its self, as i said i had adequate cover through work, which they said that would have been money in my back pocket if i made a complaint, followed by if i had cover i should have told them.

    they seems to miss te point that part of my complaint was i was told i had to have the cover.

    If i have no joy, would it go in my favout they dont have any records about the sale of either account. and is it likely they may chnage the mind after having my letter asking them to look again

    Hi there, this is a fob off, i would write back to them and ask them to take another look at this. The fos wont look too kindly on the reasons they have given for a no, this is hog wash, dont stand for it and tell them you will take this to fos.You have good reasons for mis sell and you only know about mis sell now because of the media.Good luck with this and keep us posted x
  • I emailed Northern rock the template letters to reclaim missold PPI 5 days ago and haven't heard from them at all. What timescale should I give them to reply?

    Hi Smithy

    I would write back and tell them you have only recently heard of the mis selling of the ppi and if you had known about it over the last few years you would have pursued earlier.

    It seems like they are more interested in themselves that your complaint, I would defo write back and tell them what I do say to most, is that the FSA are punishing banks who have not investigated complaints properly, and if they have rejected genuine complaints.

    You should then say that if the policy was discussed to you in the first place by their sales staff, then you would have then been given the opportunity to tell them you did not require the protection as you were already covered by your employer.

    And of course if they have nothing to go by - they are in no position really to decline your complaint, that is my personal opinion anyway.;)

    So its up to you if you want to write back with this further information, if you do give them a timescale before you decide to take your complaint to the FOS.

    Hi there

    They have 8 weeks in full to respond, if you hear nothing by then, follow it up with them, even though if you have not heard nothing at all by the time 8 weeks have passed, you are in your right to complain to the financial ombudsman service (FOS).
