Do but i really would complain to the information commisioner especially as its vital information. If the person who you spoke to won't help go one step up and continue until you get someone to listen. This is their job they get paid for it they have the ability to fine capital one or get the FSA involved as they are not providing the information that they should do.0 -

I have recently had an Egg Card with a debt of £4800, the debt was passed to Capquest who gave me a settlement figure of £4200, I then sorted myself out with a loan and paid Capquest the £4200.
I have rcecently written to Egg to claim misold PPI, they wrote back 2 weeks later saying they owed me £750 which they would credit to my account,was really chuffed. I have just looked and they have taken £600 back off my account saying I still owed them this £600, is this right? I called Egg and they have told me to take it up with Capquest. Have I lost this money for good?0 -

Can you confirm that you still have the same egg card that you had the original debt on. If this is the case have you received a letter from Capquest in relation to settlement of the figure. If not get it now!!!! This is your evidence that the debt is settled in full and egg card had no right taking the money off you.0 -

Any one have success with HFC/Beneficial Finance. I still have not received a final response from them and I sent my first letter in Ocotober. My case is now with FOS so I'm in for the long haul.
HFC/Beneficial Finance have said that they are still waiting for the papperwork to come back from storage. But I have my copies of the agreements which actually are actually not signed by me and say original copy.
Do you think I have much chance of getting a refund, it has been nearly 5 months now?

first plus confirmed cheque in the post should recieve tomorrow, as you know they decided to pay up the whole of the policy :j :j But i believe it has nothing to do with the ombudsnman form its because I EMAILED THE MANAGING DIRECTOR..:eek: I told him exactly how his customer care team had dealt with my complaint and that the tactics used were appauling i felt bullied in accepting the rebate and was told in no uncertain terms that if i took the rebate i couldnt persue my complaint.....:mad: ...
Obviously I didnt get an answer so a week later I EMAILED AGAIN saying i was still waiting for a response from him 2 MIN later the phone rang offerring the full refund and a email from the MD saying he had asked his team to look in to it the day it was recieved obviously they hadnt but i would have a response by the end of the day!!!!! and I DID :T
I never thought id get a response but it certainly worked for me........

Just looked out 2 letters from Capquest, the first is offering me settlement at £3650 but had 5 days to find the money so I called them and they said I would miss the offer but they would hold it at £4200. The second letter states 'Agreed Settlement Figure £4200 which I held with £10 payments every 2 weeks for a month until my loan came through. \i also have a letter from Egg stating my account has been terminated and debt passed to Capquest.
I know that morally the £600 is money I spent but this concerned me as without claiming my PPI I wouldnt be able to afford to pay £600!Cant help but feeling a little cheated.
Who should I speak to? Egg didnt want to know...0 -

ok sorry for the delay was thinking. If your looking to reclaim the PPI because it was mis sold then you need Egg to identify that:
1. The PPI payments was a contributing factor to you becoming in debt.
2. The PPI claim has no releivance to the debt repayment that you made.
Basically what you are saying is that the original case has no bearing on the fact that in the first place you were mis sold the PPI. The fact is that it actually caused you to go into debt and therefore the company are financially beholdant to you to assist in recovering some of the debt in the form of a reimbursement. The agreement that they had with Capquest is neither relevant or does it pertain to the current case of the mis sold PPI.0 -

After several letters going back and forth, Barclays have said that they will only provide me with a refund of the insurance premiums together with the associated interest paid by the amount being deducted from the current loan balance I owe them, rather than the cash/cheque I asked for.
They claim they are allowed to do this. Is that correct?
Should I now go to the FOS? Bearing in mind Barclays haven't accepted fault, but have claimed that the PPI would have been of 'minimal cover' given our circumstances.
What's the best step to take from here?
Any help/advice would be greatly appreciated.0
