    received a letter today offering refund of all premiums of PPI for Halifax credit card.:j

    Only problem is they want to credit it to my account. :confused: What's the procedure for getting a cheque instead? Am I legally entitled to receive the money as a cheque or do I have to accept it being credited to the account?

    Very happy, not seen any successes with Halifax on the posts I've read (I stand corrected if anyone knows otherwise).

    Anyone else claiming from Halifax, hang on in there. Mine was easy compared to some stories I've read here. Don't give up!!

    good letter however technically they have got 8weeks to respond to your request if its the first instance of it.

    I have spent a couple of days going through the posts - thanks to DayNurse i followed the threads and you have had a great outcome. I can only dream of the same!

    I have sent First Plus the letter from this site stating:

    This is due to the fact that I paid a single premium for my policy but did not see it through to the end of it’s initial term after paying back my loan earlier than planned in May 2007

    This is due to the fact that I contacted you in September 2006 and you informed me that I could only cancel the policy if I accepted a refund of 2246.86 only reducing monthly payments by 17.25 I consider this to be an unfair reund and this was not acceptable.

    This is due to the fact that I was not given the correct information when the policy was sold to me, as
    • your salesperson did not tell me that the policy was optional
    • your salesperson stated / implied that taking out the policy was essential for me to get the associated credit .
    • your salesperson did not give me full information on what the policy would and would not cover for example that the loan only covered the first five years of my loan term.
    • i am concerned the sales assistant that sold me the policy has no financial background and the policy was not sold in my best interests.
    If they reply and reject my claim (im sure they will) should i add 'uberrimae fideli' to the second letter?
    Also the FSA critisism on PPI in October 2005
    Can anyone give any extra/other advice?

    I start as a student nurse in march with 3 children so any financial success would be amazing

    you definatley can claim under the unfair rebate terms " the Financial Services Authority has stated partial refund terms to be unfair under the Unfair Consumer Contract Terms Regulations 1999. They state that refunds should be ‘calculated fairly’ after taking into account ‘justifiable costs’. I do not believe the rebate given was fair"

    I certainly wish i had taken control of the old finances earlier, never mind have to just keep battling onwards!

    Any idea of how much i should aim to claim back my wish target 10,000!!:think:

  • Good luck Any Chance, I've just finished my ombudsman forms today and will post them off this weekend. First Plus have offered an "enhanced rebate" so far but it isn't enough in my opinion. Unfortunately we still have the loan and so I want the PPI removed totally.

    Sounds promising, sorry ive forgotten did you go for the misselling or unfair rebate?
    What was their enchanced rebate? (just out of interest)

    These companies who are at a huge advantage in knowledge and position over the average applicant, need to be penalised for not informing us sufficiently over the phone and on paper. Stating exactly what is involved with front loaded/singlepayment insureance, not being covered for the whole of the loan (only five years), not telling us it is optional and that we could go elsewhere and only sending us details after signing any papers

    cheers - ive been asking for the info all along and they have never sent it ( apart from the latest t&c as i mentioned earliur)- plus they have given their final response - im tempted to refer to the ombudsman now and tell them that capital one failed to supply requested info
