    Obviously I didnt get an answer so a week later I EMAILED AGAIN saying i was still waiting for a response from him 2 MIN later the phone rang offerring the full refund and a email from the MD saying he had asked his team to look in to it the day it was recieved obviously they hadnt but i would have a response by the end of the day!!!!! and I DID :T
    I never thought id get a response but it certainly worked for me........
    never give up so all the FIRSTPLUS posters you know what to do..................!!!!!!! :shhh:;)

    Thanks for sharing ill definately remember that one down he line, actually i think i will start emailing customer complaints today rather than wait for a letter back from them (just incase they say they did not get it)

    Hi
    I am in the middle of making a claim from Picture Finance and could do with some advice. I have sent the 2 template letters to picture and was fobbed off, so i've now sent a letter to the FOS and very surprisingly have had a letter from Picture within 3 weeks.

    Our complaint was the usual i have included below what we put in our FOS complaint:

    I was not given the correct information when the policy was sold to me, as ;
    Thier salesperson did not give me full information on what the policy would and would not cover for example that the loan only covered the first five years of my loan term.
    I was not sent full details of the insurance and therefore have no information of whether the policy would actually cover me in time of need. i.e. no information was taken of previous medical conditions at the time of arrangement and we could not check the policy conditions as we were not sent any details with our loan agreement. Although the company have claimed we were sent an 'insurance booklet' with our paperwork, the paperwork received (in good faith) did include very brief details of the insurance which we believed to be complete. Having never seen a booklet we did not know it was missing and believed what was sent was correct. to this day we do not know who the insurance was with and if we were covered.
    I am therefore concerned the sales assistant that sold me the policy has no financial background and the policy was not sold in my best interests.
    •I have paid a single premium for my policy but did not see it through to the end of its term after paying back my loan earlier than planned on the 19 June 2007. Therefore I have paid £8732.50 for a 5 year policy whereby only 2 years has been used. A refund of £770.32 was deducted from the final balance which is not proportionate to the total cost of the insurance and how much of the term was not used
    Although we were given a cooling off period for the loan this included the insurance premium, they were not separate, therefore if we changed our mind on the insurance we would have had to turn down the loan aswell.
    As I requested the insurance due to the size of the loan and for peace of mind, i feel that Picture Financial 'took our money and ran' without ensuring whether we already had existing inurance, a definate need or if they were able to fully cover us.

    The letter we have recieved from picture says they still do not uphold our complaint and confirms we were told about the 5 year policy, they also state we confirmed by phone that we had recieved the brochure and had no questions.

    They have however stated that they do not feel the application met thier exacting standards and so have offered us an exgratia payment of £1952. (we are claiming about £8000)

    My concern is that they seem to have ignored that fact that no one asked us about previous medical history and although we did recieve the brochure we have never recieved any insurance details nor policy. In fact we were unaware that we hadn't recieved this info until they told us it was in the brochure when we complained. We therefore are not going to have any questions about a document we don't know exists. there is also the issue of the cooling off period, again ignored.

    So should we accept thier offer or fight for more, also should we now deal direct with them or should we go through the FOS as we have heard nothing from the FOS since we sent our complaint to them other that confirmation of reciept of our letter.

    Please can some one help??? :confused:

  • I am In the same boat with First Plus, i have a plan that when they offer me a low amount i will refuse and push it further - they shouldnt be allowed to make such an obscene amount of money from in my opinion devious untransparent selling tactics.

    But will i be brave enough to turn it down when the time comes i dont know. I think looking at others determination like DAYNURSE will keep me going

    Fight for more.Have you got a copy of the telephone call?
    We have asked for this from First plus.....They are the same 'we did this right ,we did that right' but how do we know?

    Hi, not got a copy of the telephone call and am definately wanting to fight for more. I'm frustrated that they seem to keep ignoring some of the key points of our complaint, but why have they come to us direct and not included the FOS who are handling our complaint?? have we finally got them rattled??? hope so. We will request copies of telephone calls if it comes to it.

    Yes get a copy of the call if you can......if they say no then have they got something to hide?

    Getting the FOS involved seemed to get Picture moving fast and getting copies of all calls would prove they never asked about previous medical conditions which would further strengthen our case. I'll probably call the FOS first thing Monday as i don't want to complicate or confuse thier efforts.

    you just need to be a 100% what you are claiming for the unfair rebate or misselling I claimed for misselling however I cancelled my policy also and was not happy with the rebate offerred thus the offer of 78% but was told had to not persue my complaint if accepted rebate.....yep underhand bullying tactics:mad:
