The whole thing with FirstPlus is starting to grate on me, I am getting nowhere, it was sent to the FO in October only just being looked at now, they dissmissed my claim with the first letter saying it was their final decision, they never even gave me a chance to write a second, so I guess they are pretty sure of themselves, still I have to try I know I was missold, God I'm frustrated, Interest rates have gone down still no sign of any letter from them reducing payment, good job they didn't put them up, my payments would have increased the very next day.

I tried to claim back PPI on a loan I took out with Direct Auto Finance (big mistake!!!) I was not told the policy was optional and was basicaly held to ransom until I signed all the paperwork. I did complain about the policy a few days after but recieved no reply.
I have recently contacted Direct Auto Finance about the policy only to be told that I had no claim as the time they were not registered with the FSA at the time the policy was taken out which was 2004. If I had known this I certainly would have went no further in the loan application.
Should I take my claim further and who should I contact.
Again just because the company isn't registered with the FOS then this is not the end of the road it just means that you have to do the leg work and not them. Don't dispair though they may have registered with the FISA which was voluntary. Again send a registered letter with the template stating about the 1967 Mis representation act in which you believe you were mis sold due to negligence on the part of the company as they didn't inform you that it was optional. This makes it their job to prove otherwise. Give them 8 weeks to respond. On no response take the matter to court.0 -

One view is the more the better however sometimes its better to be concise and brief. Try and break down what your trying to say and how. What your complaint is ie you have asked the company for a full refund and they have responded in the negative however you don't believe they have taken your complaint seriously. "From the evidence you have acquired you can show that they have deliberately mis sold you a policy that you neither required or needed and therefore should be refunded the policy costs plus interest."0 -

I basically said exactly what id said to first plus and commented on the recording pushing the 5 year rebate enticing you to take it and one of the advisors said its not worth claiming for within the 5 years people mainly use it for life!! so what was the point of having sickness/accident etc i didnt require it also told them about enhanced rebate offer that i hadnt asked or requested it come off the loan just put everything on as you can type it in theres no limit the more you put in the better I sent them all my letters all the letters recieved and the recording disc they have all the info in front of them then!! obviously keep the originals i sent it recorded mail

Hi,
I'm having trouble getting my head around an agreement we had with Blackhorse. I have posted the details below. I cannot get a copy of the actual settlement figure and how this was broken down, just the statement. I realise that the opening balance is the loan amount plus ppi amount (not inc interest).
What I need to know is how much to ask for through the court?
Do I include the interest added by Blackhorse (£606.63) as this doesn't appear on the opening balance and doesn't seem to be reflected in the final repayment.
Also how do I work out the 8% interest for the court?
Can I use the calculator on this website and enter it as if I'd paid 48 payments over 48 months?
I hope someone can help me with this as I am on the verge of giving up, it's all getting too confusing.

HI All, l've just had a quick read of the mis-representation act 1967 and there's lots of thereto's and thereof's!! in normal terms does this basically mean that if the t&c's were not properly explained i.e. self employed have to cease trading etc that it is a case of mis selling, if you understand whatl mean!! l hope l get a refund soon as l want to put one of those little jumping men on my post!0
