One point to make remember during this it isn't your problem it's now theirs. They are still under regulation via the information commisioner so if they don't reply to your request in 8 weeks get him involved as they are required by law. Halifax are all growl and no bite have taken to court 4 times so far and now am threating to send the baliffs round to there head office:D

PROS AND CONS OF MCOL AND FOS
MCOL
PROS Fixed timeline and if they don't respond they immediate decision in your favour timeline approximately 28 days - 2 months. Get court costs back and don't have to pay theirs (Usually guarenteed a win under £1k).
CONS Limited amount able to reclaim £5000 and you may have to attend the case in northampton if they think they have a strong case. You have to work out how much you want back plus the statuatory interest of 8%.
FOS
PROS Will do all the chasing for you working out the exact repayment if in your favour plus all interest and possibly compensation for trouble. Can go to MCOL if they don't find in your favour still.
CONS Timescale 6-9 months averaging really relieant on replies from the company involved.0 -

Obviously depends on the amount but yes if you are granted a warrant from the courts you can do this. I would have like to do it too my old branch as revenge can be sweet for the embarrisment factor. As for leaving it as their problem don't leave it but make it their problem as they have been yours for too long remember this is consumer fight back. You're in the right not them keep us posted how you get on and i will advise as possible.0 -

I understand but if you attempt this be warned that it could back fire. If you phone and ask for a copy of the phone coversation and then they "forget" then you will wait and have wasted even more time. I only tell you this to save you time mate plus you need to focus on the big picture when you claim all the letters are evidence against them without these you have nothing to prove anything. A couple of quid to make sure you win is worth the hassle in the long run. At the moment you have nothing to lose however if you don't do it properly you could end up going to court to get it throw out or complaining to the FOS with no evidence as they are the next step if the banks don't pay out.0 -

im with you, how can i prove i phoned them if i have no proof....
letters from now on then to all companies, but halifax i trust, they even recorded the phone call and was on the phone for about 20 minutes with my complaint, but from now on letters only0 -

don't count on the halifax they will use every trick in the book.:eek:0 -
I know, but i'll give them the benefit of the doubt and give them till monday then if not ive got the templates saved on my works computer, its easy enough to print them off and pop the post office at dinner0
