    Check your terms and conditions on the PPI cause i'm sure you'll find the clause saying that you can't claim if you're self employed. Go on check and if so then you have a clear case of mis selling and take it all the way.

In your case i would get one person's name and try and build up a relationship with them so you can check in everyday just to find out the progress. It does help believe me and 9/10 times the person who you talk too actually agrees with your attempt to reclaim so be polite and considerate and it pays dividends in the end. I know its hard to be civil after them screwing you around but the last thing you need is to either get stressed out or lose you temper as it achieves nothing and you could take it out on your family (unknowingly). All i'll say for anybody reclaiming stay patient follow the right road to achieve your aims (either FOS or Moneyclaim) and don't hestitate to ask for help as its free and nobody will ever judge you on this thread. :D Else they'll have me to answer too as nobody is perfect (except my beautiful son).

    On additional note make sure you make copies of everything you send and receive. Make a phone call log sheet with the name of the person that you talk to giving them a reference number too so you can reference the call as well as taking notes for yourself. Get yourself a box file and orginise yourself as things can get messy. Also write an index on the front so you know where everything is when you need it.

    Thanks for the advice,yes things can get messy so l've just written a list of who l've written to about what and when they were posted,as l've got reclaiming charges going on too,and thats for being nice to people, lm always nice!!!
  • I had a loan with first plus and they put £6377.60 ppi onto balance when i settled loan after only having it for 6 months they only refunded £2246.83 off the ppi leaving us to still pay £4130.77 of the ppi even though we were settling so early, ive sent numerous letters to First Plus but they wont budge, what can i do??
  • Try the ombudsman....or at least threaten them with it.good luck.

    i cannot look at the t&c for the lloyds one as i no longer have it - i asked for a copy but they never sent it and i asked for a breakdown of the difference in employed cover and self employed cover at the time the ppi was sold and they have not provided this - ive included this in the submission to the ombudsmen (it was an insurnance that was added at the start of the loan)

    now i think capital one have been crafty and sent me the most upto date t&c - its states you can claim for redundancy or business failure if your self employed (????) not sure where business failure came from but im sure it was not in the t&c in 2001 when the card was first opened?? - still cannot claim for unemployment unless the business has ceased trading

    i also asked them for a breakdown of the difference in employed cover and self employed cover at the time the ppi was sold and they have not provided this

    what do you think my chances of getting a copy of the original t&c are as im sure the ones provided have only just been published??
  • Well Worst Plus phoned me today so I've just phoned them back and they've gone through their "enhanced rebate" figures with me. I told him to send the letter anyway so I have it in writing. Then at the end I told him that I still wasn't happy with their response and would therefore be taking it to the ombudsman. I was a little disappointed with his response which was very matter of fact and said "well they will then ask for my case files which I will provide and then they will make their decision". I guess a little part of me wanted him to say "NOOOO, don't do that, let me give you all your money back immediately". :D Well I can dream can't I!?

    So tomorrow I do the ombudsman forms. Any advice on filling it out please? I don't want to say something slightly wrong and mess up my case!

  • I've now had the phone call info but I think we still have a case. Unfortunately for First Plus they have already refunded the "enhanced rebate" to my loan account, amended my monthly payments (hardly worth it!) and cancelled my PPI insurance. NONE of which I have authorised! If I don't have a letter by the end of the week explaining why they did that and assuring me that they'll put it right then I will be proceeding to the ombudsman. After all, I hadn't made the decision to accept their pathetic offer and now they have removed any option I had - namely hanging on for 2 years for the refund!
    Do you have to pay for a copy of the call?

    hers some of the wording re unemployment

    Provided by AXA Insurance UK plc - you are only entitled to this cover if it is detailed on your Certificate of Insurance and
    you have paid the relevant premiums
    If you are unemployed due to redundancy (if employed) or business failure (if self-employed) after the starting date
    and before the end date for at leilst 30 consecutive days, subject to the Policy terms, we will pay a monthly payment to
    Capital One Bank (Europe) plc. We will also pay a monthly payment in respect of each full month after thilt, during
    which you ilre continuously unemployed, until the first of the following occur
    you cease to be unemployed:
    - we have made 12 monthly payments in respect of anyone event of unemployment:
    the date the outstanding balance as ilt the date of your unemployment has been paid;
    - the end date.

    If you claim for unemployment is states you cannot claim is your are self employed and have not ceased to trade
    quote

    We will not pay benefits in respect of unemployment

    b) someone who is self-employed or by a partnership where the person who is self-employed, or ilny of the partners
    of the partnership, is your husband, wife, partner, child, brother or sister unless that person or pilrtnership ceases
    totally and permanently to trade as a direct result of an inability to pily its debts as they were due, as a direct
    consequence of which, and immediiltely after which, you suffer redundancy,

    really odd as another part of the form that i cannot copy it says you are excluded unless you cease to trade

    so you cant claim unless you cease to trade and then if was not because the business was in debt?? - i just dont get it at all now im really confused
