Hi all!!
I need a little help. I am having real problems with Welcome Car Finance, where I want to return the car after paying the amount they say. They are refusing to accept the car until I have paid up all the PPI of over £800, is this allowed? I'm really stuck and also very angry with them! Should I pay for it and then get a refund, or is it my fault for taking a loan out with them.
Deep Breaths (Your dealing with Welcome here). Ok i'm guessing your returning the car as you nolonger want/can afford it. You haven't default on the car payments but have come to an agreement with the company whom will accept it back and discharge your loan. If this is the case you start going through the check list.
1. Did they tell you that it was a whole life policy ie for the term of the loan?
2. Was it a front loaded policy ie was the PPI paid right from the off in which case you owe them nothing (ask them) If it was a single premium then it probably was.
3. Ask them to send you the documentation stating that you must repay the PPI.
4. Get a copy of your CCA as this could go either way.
5. Don't be afraid to get stuck in as they have a very bad rep.

Thanks for your help. You are right there are no defaults, we just no longer want the car, and under there policy we can return it. I've searched through the terms and conditions and it states
"you may cancel or settle the ppi early by paying us a sum (calculated by us and notified to you) equal to the balance of the premium for the ppi together with such element of the finance charge as related to the ppi, less a rebate calculated under the act! So it looks like they've stung me really (or my partner as it is actually his, as I would never have gone for it - lol) I just can't believe they still want over £800. I'm not sure what the CCA is so I can't do that. I will definately try and avoid paying for it if I can though, as there such a con!No more spending hard - Time for the scrimping!0 -

im trying to claim from halifax, mbna, and liverpool victoria...
after speaking to halifax to ask for T&C's of the PPI they asked why and i explained how i felt pushed in to having the PPI with my loan and so i went with their advice, and theyre getting back to me in 5 working days with some kind of letter, even if its just to put a name to my claim, which is great!!!
Liverpool Victoria have said to write in due to the shear amount of calls they are taking at the moment which is also great!!
MBNA on the other hand basically had a go at me and said i signed for it and had the terms and conditions and that they'll send the T&C's out for me, but the way the guy spoke to me was just ridiculous!
can i put that forward as part of my claim, or is he right that because i signed for it i havent got a leg to stand on....
on my halifax one i was in the branch with the women so didnt have time to read though it all, but the mbna and liv vic one was done on the phone initially, then documents sent to home address to be signed and sent off for....
do i have a case of mis selling?0 -

The loans which relate to the loan over the phone claim against the consumer credit agreement of 1999 which specifically refers to selling with over relience on postal documentation.
The Halifax one claim state against the Mis representation act of 1967 which makes it up to Halifax to prove that they didn't mis sell you the policy.

I presume this is for me lol. My partner took out the loan and is paying for it. I'm just dealing with this as I think its ridiculous. I know he was told he wasn't allowed the loan without the insurance and I think he did it all over the phone, but I do remember him signing when he brought the car, although that wasn't directly from Welcome.No more spending hard - Time for the scrimping!0 -

where can i find these acts so i can quote some fancy wordings from them or even quote the whole thing?
i know with the halifax one i can claim that it was forced upon me and rushed as it was done face to face with no time to think or read through any details, but the ones on the phone im not sure...
thing thats gotten to me, is i took out a loan with liv vic taken out for 5 years, paid off after year 4(a week ago), i was ill like 7 times, but because it wasnt over the 31 days i could never claim, however i was ill, 7 months in a row, 2 weeks at a time, in hospital 4 of those times too but could never claim0 -

Yes it was for you lol. Ok if he signed for the loan in the car companies office then there is a good chance that the person who sold him the loan hadn't been trained properly into how to sell PPI and therefore i expect him to be responsible for the mistake. I would contact the car seller and inform them of welcome's stance and that if you paid them you would be looking for compensation from them as you believe that you were missold the policy. PS this might effect you returning the car.0
