So, I am now preparing to start civil proceedings against RBS. They have told me twice that they don't think they have acted improperly but they don't have transcripts of the calls so I don't see how they have come to that conclusion. I have cited the Misrepresentation Act, in a letter that Tiggrae posted (THANKS TIGGRAE!), but they don't seem too bothered about it. So I don't feel like I have any other choice.
Anyone got any rough idea what I should put in my particulars of claim?
Basically, they didn't tell me the PPI was optional, how much it costs, what interest was applied, was the cover right for me etc, they never explained any significant clauses or endorsements on the policy or if there was any option to cancel.
I want to get the wording just right so any help would be appreciated.

I have written to HFC to claim back PPI charges applied to a Credit Card account from 1999. HFC have written back to say that we filled in an application form on-line which is correct and that we check marked I wanted PPI . Now it could be on the form I had to uncheck the box to say that I didn't want PPI but basically they are taking the line that I asked for it, I signed to say that I understood and agreed to the T&C's, I didn't cancel it in the 30 day cooling off period and I didn't query the payments until Aug 2003 when I called and cancelled it.
Do you think i still have a case where I was miss sold PPI when basically I didn't really know what it was and never sought advice.0 -
Have a loan with Welcome, taken out in januray 2007.
Insurance total amount it £1157
Can I claim this back, I just ticked boxes for insurance. Or do I not have a case.
Has anywhere got anywhere with reclaiming from welcome?

No Jillie, I am/was chasing GE Money and it went to a final response as Creditlink were who brokered my loan and FOS sent everything over to creditlink who have ceased trading now so I think I am on a loser

I was enquiring about the same thing.
I paid my loan off early with Welcome.....and got nowt back from the insurance, in fact we got one quote from them when we were sorting out finances for closing the loan, it ran over a week past the deadline for the last quote and would you believe........EVEN after ANOTHER payment was made the quote had JUMPED another£350......what was that all about......So, any advice here too would be really great, good luck studentchick !!!!!!

Sent standard 1st letter requesting reclaim because I was self employed and didnt want it in the first place but was pushed.
Reply saying I had the book, it was explained to me etc
Wrote a 2nd letter asking for a full list of differences between a employed and self employed persons cover. And quoting the missreprasentation act etc(Cheers Tiggrae for the help)
Today(day 56), letter offering full refund, £1000 which is arreas then the rest(£620) in a cheque, i'm going to ask them to take the lot off the loan then pay the £420 which is left on the balance next week. Mainly so I cant spend on anything other than paying off debt.0 -
Hi wonder if anyone can advise, Tuesday I posted a success, I wrote to Blackhorse who financed my sofa's through DFS same old thing sales man ticked box etc they sent letter to DFS the manager called me and advised that I would have to have a new agreement go in to store restart the whole thing again although two payments left on sofa's (manager has advised to let the next one go through) so there will be one payment left of £63 to pay and I have to go through the whole thing again, quite honestly I don't want them to start a new agreement pay back all the money I paid over the last couple of years and then I deduct what is owing to me and then pay off the sofa's its hassle and time, so my thought is if I pay the outstanding balance, hence agreement is over will they then pay me the money they owe me without all this hassle...

i know thw feeling and im sure they will tell me to sod off as well theres so many dealing with this company you would think something would be done i have a phone number for the complaints exec who is dealing with my case ive rang twice and get through straight away have you not got a direct number if i havent heard anything by friday i will be ringing again!!!

Anyway, it's all irrelevant now as i have posted the acceptance form (recorded delivery,of course!) & just waiting to see how long before the cheque makes an appearance! I recently sent a letter to the Insurance company who were the holders of my policy on a loan which I had taken out. I wanted to know if I was in a position to claim back my premium (almost £3500).The reply I received was very curt and to the point.They said that the insurance was offerd by the loan company and therefore I needed to conact them to see if I had a valid claim.They also said that if I read the small print that I was actualy covered.
At the time of the loan I was self employed so I was under the impression that Iwas wrongly advised. Can anyone give me any advice on what to do next.0
