Hi there I realise this has probably been asked before, but how far back can I claim? Is it 6 years like the bank charges, or can I go back to the start of the loan? Also, as I have already claimed around £2500 of bank charges with them, would they threaten to close my accounts? I'm with HSBC. Many thanks.

Hi Lisa,
The lenders are now using the FSA regulation and time frame as excuses for not providing redress. This is the problem with attempting to claim for mis-selling only. I never claim for mis-selling on its own as the lenders usually get one or more other issues completely wrong so there is usually something else to hit them with. You just have to know what.
Hi Peter, hope you can answer me this question. I have had my credit agreements back from citi financial & noticed what appear to be anomalies on the agreements, do you know who i could go to for advise & explainations about these before actually approaching citi, as i know they'll try (& succeed) in blinding me with jargon or similiar. I have been trying to reclaim PPI on a credit card from HSBC due the fact that I believe I have been pushed into the decision and not correctly been informed that I could get the CC without the PPI.
Sent 1st letter 14/11, had 3 letters from HSBC saying they were looking into it, just after Christmas they told me they don't agree. Sent off my 2nd letter on 14/01 giving them 14 days to respond again...haven't heard from them since.
What to do next? I read Martin's guide where it says to go the FOS. Should I already or send one more reminder to bank? Am just a bit worried that once submitted to FOS, it will take forever and I might have been able to avoid it by sending one more letter to bank directly?

I have sent the last letter to HFC and have received a letter stating that they are sorry for the delay in bringing my complaint to a close and that they realise that they are outside of the 8 week time frame but hope to bring my case to a close asap but I am within my rights to go to the FSO.
I have already had my case accepted by FSO but realise that this will take some time.
HFC are saying that they are waiting for my paperwork to come from storage and have been doing so since October. My question is that I have both copies of my loan agreement and it says that it is the Original Copy, but I did not sign for the PPI on any of the forms. It definately says that it is the original copy and where my signature is supposed to be is blank. What do you think that this means for my case and should I foward this information to the FSO?

Many Thanks for the reply. am just about to draft my second letter and will ask for a copy of the recording, and add a couple of things i have only just found out about (continuation of payments after end of ppi and not being told i was not covered by the ppi) should i now ask for them to terminate my ppi contact? will they let me? and will they then take the ppi amount (in my case over £100 a month)off the loan monthly payment? I'm really unsure about that part.0

Although I have the original customer copy of the loan agreement, I dont ever recall having received paperwork concerning the ppi. I dont even know who Woolwich Plc took the ppi out with.""""
I then finished off the letter using the rest of Martins template guide.
Im still paying off this loan and have about 5 payments left plus the ppi payment, which as far as I aware is now absolutely useless to me and has cost me approximately £2,500. Do I have a valid claim.

hi sian the payments continue for the life of the loan including interest for example mine £8000 PPI paying 62.00 for 300 months is ...approx 18000 and they wonder why people are up in arms ive had the loan 2 years told them i want o cancel offerred me 13000 and my payment would reduce by 9.00 whoopee do not accepted wrote back saying unfair rebate etc now offerred me 78% rebate which should be 6222.00 but only offerred 3,900and they want to take it off my loan sent it back saying no willing to comprimise but also after hearing the recording feel the policy was still misssold i said if I didnt get a favourable response will go to the ombusman and claim the whole amount back 8,000,+ the 8% stat interest any court would give!! balls in ther court now

Having looked through all my doccumentation there is nowhere i can find that it clearly states that the ppi rate would still be charged even though you are not getting the cover. (in my case it is 106 a month) are you still paying your loan or have you paid it off already? Good luck with your claim0 -
don't let them fob you off, what they mean is you can't take your claim to the Financial Ombudsman as it's outside their timeframe. Tell them you believe you were negligently misrepresented to and under the 1967 Misrepresentation Act the onus is on them to prove otherwise and if you don't get satisfaction you'll take your complaint to the County Court
I have now received a letter back from Direct Auto Financial Services who reiterate their stance that they categorically reject my claim of Negligent Misrepresentation and confirm any legal action will be vigorously defended. Can you assist me any further?0 -

that is my first priority as for the PPI have cancelled it but they tell me it will save me 9.00 a month the interest has gone up again therefore no saving.
so whatever rebate or offer they make i want it paying direct to me

I just received my Lloyds credit card staements and have ~£2000 PPI charges over 6 years, what I'm not sure about is if I can claim - as obviously I have no recolection of when I applied for the card? Do I request repayment anyway and hope they've lost the phone conversation recordings?!? I was in full time employment but am unlikely to have agreed to the PPI as I would ahve wanted to keep any cost near to nil.
