    With my claim, I'm preparing my Particulars of Claim to go to court (using Newcastle as I did for reclaiming my bank charges from them - it's handy for me!). I'm extremely hacked off with the Halifax. As other have commented on here, there Customer Service is appalling (when I reclaimed bank charges - the Collections teeam registered a default against me after the court date to settle my claim as they knew nothing about the court case as Customer Services 'hadn't put a note on the file'), and in respect of my PPI case, I had a member of their staff in the Chief Execs Office accuse me of fraud (as the CCA they sent me was not in my handwriting - I believe it was written either a few months back or at the time the account was opened to try and justify the PPI they were charging) by saying that if it wasn't in my handwriting, I must have authorised someone else to open an account in my details. I'm totally bloody raging now thinking about that accusation now - let's see how damn smart they are in court. After all, they are handwriting experts with one of their Customer Service Managers writing to me and telling me it was my handwriting despite my name being spelt wrongly on it!!!:rotfl:And my profession being described as a "Charta Surveyr" :rolleyes: You'd think they could at least pick someone who could spell correctly to fill in the form, wouldn't you?

    I notice in one of your other posts that they quoted the Association of British Insurers Guidelines in 2001 to you. They did the same with me to justify their failure to send on copies of the terms and conditions of the insurance to me retrospectively. Apparently the ABI guidance says that only customers who go into a branch or apply for a card over the phone are given the opportunity to see the t & cs for the insurance - anyone who applied by post doesn't and are exempt from seeing the terms under ABI good practice guidelines. Something, which I'm convinced is a complete pile of p*sh.

    Anyhoo, I anticipate that the Particulars of Claim will go to Newcastle County Court in the next fortnight or so. Thereafter, it's up to the Halifax whether they attend court or not. I will. I'm not being accused of being guilty of fraud by some muppet in their Chief Exec's Office, and I'm certainly not having someone suggest that I cannot spell 'Chartered Surveyor' properly!

    That is awful!


    It appears that Royal Mail cannot be relied upon to get a signature for a letter. At £1.04 it may not sound much for one letter, but when doing 3 each time for me and OH has had A Lot of credit/loans it's totting up.
    Anybody had any issues with dropping letters straight into their local branch?
    (I was thinking of typing a covering letter along the lines of "unfortunately Royal Mail have been unable to obtain Proof of Delivery from your registered offices, so the branch office will have to do")

  • Just had a rasponse from GE Capital re Debenhams saying that they can find no evidence policy was mis-sold and are declining my claim. Given that GE Capital are one of the companies who have been fined for mis-selling, where do I go now? Any suggestions or hints as to what to put in a letter would be greatly appreciated!! Drafted the one below but not sure about it!!

    I am writing in response to your letter dated 31st January 2008 with regards the insurance sold with my store card. Your reference is xxxxxx.

    I do not feel your letter has offered a satisfactory justification that my policy was sold fairly, reasonably and within my best interests so I request that you look into my complaint again. If I do not receive a more favourable response within 14 days I shall be taking my complaint to the Financial Ombudsman.

    GECB was in breach of the FSA's Principles for Businesses 2, 3 and 6:
    Principle 2: A firm must conduct its business with due skill, care and diligence.
    Principle 3: A firm must take reasonable care to organise and control its affairs responsibly and effectively, with adequate risk management systems.

    Hi, both me and my husband have seperate loans from Welcome (yeah I know, bad move!) and I'm not entirely sure if we were miss-sold the PPI. We were both basically told over the phone during the application process that we would HAVE to take out the insurance and so we did then go and sign the contract that was sent to us, with the PPI box ticked (it was pre-ticked - we didn't tick it).

    Are we still allowed to reclaim this back? We didn't want it but being really unsavvy about all of this at the time we just went along with what they were telling us.

    Sorry if this has already been asked - I know Welcome have a bit of a reputation, but I've got a crying baby to tend to and haven't got the time to hunt for similar posts! Thanks!

    your salesperson stated that taking out the policy was essential for me to get the associated credit
    though there are others which will probably ring a bell!

  • Um i have never written on a thread before but have cleared 25k worth of debt!!!!! wahoo

    i took out a £10,000 loan with barclays about 5 yrs ago as a housewife based on my husbands earnings. when my husband lost his job and i went to claim i was told they covered me not him....

    this caused us to spiral into debt and after years of being hounded i managed to pay barclays with a 75 % settlement offer.

    would i be elligible to claim?? i was so angry with them for the position that they put us in and feel that they should be taught a lesson.

    yes as a Housewife you should never have been sold the policy - you've a good case

    what they've done is called 'front-end loading' what this means is that in the first years of the loan you think your premiums are paying both loan & ppi - not so, the first years would be paying ppi only - that's why you've a low settlement figure on cancellation - you've already paid the premiums in full !!!

    Hi this may or may not be what you want to hear but after sending 2 letters to GE money the second being very strong emphasising on the FSA comments about oral explanation of policies and not just providing leaflets for you to read, and reminding them of the misrepresentation act 1967, and still they wont budge!! so I have just reported them this morning to the Ombudsman and will keep my fingers crossed.:mad:

    when you make your claim ask them to send a copy of the telephone conversation as they tape them !

    when did you take put the PPI - if it's prior to 15th January 2005 it's unlikely GE came under the jurisdiction of the FOS so your only recourse would be the County Court - threatening them with the FOS has no impact as they know exactly when they came under their jurisdiction
