They emailed me to say that they would have a responce by today. Nothing in the post today, but they normally send the letter out on the day they say, so should get something tomorrow. I'll keep you posted.:)0 -

My husband and I took out a secured laon with Picture Financial last march. We took the PPI protection as the loan was rather large and we knew we would not be able to pay the monthly premium if either of us were ill, unemployed or dead!!! This PPI worked out at around £22000 on top of our loan. A single premium added on. The PPi was for five years although we have now found out that we will pay interest on this for the 25 year loan term. The added carrot was if we did not claim or fall into arrears with the payments we would receive a no claims bonus of half the total premium spread over three years with the first payment of around £5000 three years after the start of the loan.
Unfortunatly I have just found out that through ill health I am no longer able to work and am now off work permenantly. We decided to put a claim in through the PPi as we will not be able to meet the payments.
I called Picture to request a claim form and was told that as I was named second on the agreement I could not claim for ill health benefit and the only thing I colud claim for was death. We were not aware of this and are now up the creek without a paddle. I have wrote to Picture using the template from this site as I am certain we were mis sold the policy. Can anyone help? Thanks.
The problem with the template on this site is that it's more towards the Misrepresentation Act 1967, however I think your issue is the contract term within the contract itself is unfair under the Unfair Consumer Contract Terms Regulations 1999 - look on the both the Office of Fair Trading website of that of the Financial Service Authorities for further details of that legislation - the FSA actually ask you to report instances of unfair terms I'd certainly in your letter tell Picture of your intention to report this
I's also be tempted to throw in the Sex Discrimination Act as well, throw as much as you can at them - after all it's usually the female who is named 2nd !!!!0 -

finally got hold of someone today at FP they have confirmed that a letter has been sent out this pm offerring me a enhanced rebate of 78% ( the recordings i requested are also in the same envelope)however they say this will be deducted off my loan I dont see why this should be ive spoke to a gentleman at the ombusman this afternoon he said he doesnt think they have to make you do that (thinks?? he wasnt 100%) TIGGRAE can you confirm this
also once I have listened to the recordings and i am 100% sure i can say they missold what would happen if i write back and say i want the whole policy back plus 8% interest If they say no do i loose out on the 78% offer
The rebate is a seperate issue as i have cancelled my policy would i be able to for example accept the offer and proceed with claiming the difference on the misselling I am hoping to settle this loan soon but am furious that they want to take it off the loan as said by others in previous posts the policy is paid for now front loaded therefore why should i not have the refund
I am unsure what to do next they deny misselling obviously they would but i need to hear the tape as the letter states we agreed to the policy it was explained fully twice over!! difficult one HELP any ideas guys????????????????
they're having a laugh !! FP NEVER pay ANYTHING back unless they have to - you've obvioulsy got a good case so don't let them bully or intimidate you !!! The FSA has stated partial refunds should take into account administration charges etc. when you get the letter write back and get them to explain why they are witholding 22% and ask for a breakdown - also if you believe you've been unlawfully deprived of money keep on about the 8% - it's what the courts allow - remember if money's been stolen from you you would expect compensation !!!!0
