get them to explain why they are witholding 22% and ask for a breakdown - also if you believe you've been unlawfully deprived of money keep on about the 8% - it's what the courts allow - remember if money's been stolen from you you would expect compensation !!!!

Hi, i got a loan out over 5 years with Black Horse a couple of years ago & paid it off after 6 months. I have now noticed the single premium PPI i didn't want but was cohersed into is in my husbands name only, even though the loan was in my name only???? How would that work then???? Do you think i have a claim for mis sold? Thanks SUFC0

Sorry if i sounded too confusing
It is a loan I am claiming on. My mortgage is with Kensington Mortgages (who I Really do not like)
We origionally took out a secured loan using Loans.co.uk. They organised a loan with a company called Money Partners. On top of the money we wanted we also borrowed anouther £3,500 to pay for PPI. This was paid to an insurance company but was on the breakdown list the Loan company sent.
As soon as the Loan was completed we started receiving letters from Kensington Mortgages about the same loan.
When I contacted Money Partners about this they told me that Kensington now own the Loan. This did not please us but there wasnt a awful lot we could do.
in 2006 we started to fall behind on payments because my daughter was ill. I took a huge cut in wages. I knew i could not make any claim.
In August 2006 my husband became ill. He was signed off work alltogether for 6 months and had to return to work early as ssp was about to kick in and we couldnt afford it.
Whilst Hubby was oof work I contacted Kensington Mortgages about making a PPI claim as hubby was ill
Kensington said I didnt have any PPI
When I found out that we did 1 year later I wasnt very happy. as Kensington have actually tried to evict us several times because we fell so far behind on everything. We ended up going on to debt mangement
When I contacted Kensington they actually said that they dont hold that type of infomation
If they dont hold this type of infomation how can they tell me that I dont have PPI. Why do I also have a letter from Money Partners when the loan was completed telling me that £3,500 went to the insurance company.
I have now gone to FOS and am waiting for them to investigate.
I have to win this because they have bullied us for nearly two years now and they are getting ready to evict us again as i cannot pay what they want. They are Unsympathetic loan sharks.
All I want is for them to clear all solicitors fees which will clear the arrears and then pay some compensation so I can pay all the debt fees that we got before we went under debt management

I have a really (probably) stupid question. (there are sooo many pages on here I just would take about 3 weeks to read it all lol)
My husband is in the military and all of our finance agreements are joint (i do not work as i stay at home with the children). I am not named on any PPI agreements, and hubby would still receive full pay from the army if he was off sick.
We have always just accepted PPI as we were told it was compulsory when we took out our first loan with the TSB, and just assumed that it was still the case.
Would we have a case to ask for our PPI back? All our loans (except the one currently running) have been repaid early., and we have received a partial refund on one.
WE are currently waiting to receive details of 4 loans with TSB (on loan 5 - they do not have the paperwork for some reason), one loan with Intelligent Finance, one car finance with Capital Bank (ended 2004), one finance agreement with HFC (they deny receiveing any emails or letters) and am about to write about another 2 car finance agreements (one ended 2006, the other is still current).
To be really honest, the car finance ones, I would be more than happy if they were paid into my balance outstanding as it would mean my lovely car would be paid off quicker.
The bank PPI's and those of capital bank and IF and HFC, would just like them paid into my savings account to see if I have enough to pay off the IF loan in full, which would leave me about two hundred quid a month better off which could be saved up towards paying off the TSB loan, which would then leave us 400 quid a month better off (crikey we could well be a two car family if that happened lol)
Just really wondered if anyone out there would agree that we have a case to claim back these monies? Have downloaded the letters from here but would really appreciate any advice anyone could offer me?

Ooooh is it odd that I'm all excited about receiving my first standard response to a PPI claim?!
Northern Rock have sent me a questionnaire to fill out, which I'm going to return blank telling them that if they'd sold me the policy correctly, surely they'd have this information.
The thing is, the questionnaire has at the end, "when completed please send this to.." xx address, which is different from the address on the pre-paid envelope! :rolleyes2
Also, the first question asks:"Who is your policy with?"
Maybe this is just for you to check you haven't been hassling the wrong company?

"Let's see now, I'll just fill in this 'Who is your policy with?' part...." *writes Lloyds TSB* *notices the questionnaire is headed with Northern Rock, and it states Northern Rock 3 other times on the first page*
"'ang abaaaht, that's a different name! ... Cor would you Adam and Eve it! I've only gorn and been hassling the wrong company! Stone the crows! What a silly sausage! I'd best write back to Northern Rock and tell 'em it were all a mistake!"
I think not...
Mind you, I think I'll return the pink copy for the new (minus PPI) loan and get that sorted before I start kicking some Rocky butt..

well guys said letter and disc arrived they are in order to resolve my complaint are willing to offer an additional 2,707.02 on top of the 1,133.15 78% pro-rata 22% being held back for provision of claims!! and admin costs how they work that figure out have paid policy for 2 years ppi 7983.00 they continue to say its a gesture of good will no admission of liability blah blah blah they remain satisfied that the policy was not misssold (will study disc later and post) acceptance form states both amounts applied to the loan!!! not a happy bunny the figures remain valid till 28.2.08
if i cant proove they missold what do i do taking them figures off my loan will make no differnce whatsoever to my monthly payments hardly anyway and trying to sort something elsewhere any advice greatly appreciated would like to know how they get that figure to be honest
