    HI
    Can anyone let me know how long it takes FOS to get in touch and acknowledge forms. I know it takes 6-9 months to sort out, but not sure whether to start court proceedings.
    Two old PPI's. DFS (2000-2003) sent paperwork to FOS this week.
    LLoyds TSB (2000-2005) - trying to decide next step as they have sent final response, claiming "out of time".

    Has anyone had any success with court action with DFS or LLoyds TSB?
    I feel really strongly about fighting for justice against the mis-selling, but it is all a bit wearing!

    Hi, unfortunately the FOS will not look at your claim as DFS won't have come under their jurisdiction in 2000 - as for LLoyds TSB they would have what you need to say is that you only just became aware of the issue due to media attention and therefore, you are within the 3 year limit for making a complaint

    Thanks for that, it seems clearer to me as well now...put like that.
    But how will I know how much it should be....I sent first template letter, followed by a second letter threatening court action to Freedom Finance regarding an 18k loan with GE Capital in 2002, but really have NO idea of how much I would be claiming or how much the single premium was etc.Should I have asked all this first before sending the first letter?
    Have also just realised I am paying 11.5% interest as I had a letter a few weeks back to say rate had increased...paying this over something like 15 years:eek: scary

  • My mis-sold PPI claim was for a pre existing medical condition which I am trying to claim back from GE money. (I was actually off work with an injury sustained in Dec 05 when I took out the loan in Jan 06 for double glazing with Anglian windows), the sales person knew that I was off work and the reason why I was off but did not inform me of the consequences if I needed to claim. I went back to work after 8 months but had to go off sick again 2 months later due to severe pain because of the injury. More than a year after taken out the finance, I required surgery for the injury and tried to claim on the PPI as I knew it would be a lengthy recovery time and any help financially with the repayments would have been a great help. However I was refused due to it being a pre existing condition. It was just under a year before I was fit enough to go back to work but still had to meet my repayments myself. GE money state that as they wern`t "there" when I took out their finance for double glazing with Anglian windows and therefore they are refusing to refund me as they cannot vouch that the sales person from Anglian mis-sold me the PPI in the first place. I can prove that I was off work at the time but I don`t think they will budge and refund me. I feel really cheated!!!! The 2nd letter I received from them, basically said if I wasn`t satified with their response then I should refer my complaint to the FOS - in which I have printed a letter out tonight and it will be in the post tomorrow. Hopefully I`ll have a better response next time.

    Back in december i sent lloydstsb a letter stating that i did not know PPI was added to my loan account the cost of the premium was £758.32 for the 5 year loan term i recieved a couple of letters back appologising for the delay and that they were trying to find details about my insurance, saturday I came home from work and had a letter off them saying that they would refund the whole policy and any interest earned to date, all i had to do was send back a letter saying that I agreed and that the offer is not saying they did anything wrong and its a goodwill gesture so all in all with interest i will have about £1200 knocked off my outstanding loan bringing it down to £600 leaving me 6 months left to pay instead of september 2009 when the original date to finish was.

    If anyone is thinking about doing this I recommend it I only had to write one letter for the whole process which I used the template off here, and its worth the extra money that is owed back to you.

    They did that with me too. I finally got an answer from them about 2 weeks ago. I've responded demanded more information and telling them that they are wrong and I want a refund. I eagerly await their response! I've already filled out the paperwork for the ombudsman. I've thought of a few more things to add to it and then I'll wait to hear from Worst Plus. I assume their response won't be what I want to hear and at that point I'll send off the documentation to the ombudsman. Keep us posted and I'll do the same!

    I've cancelled my PPI with the Rock, but I had to re-take a loan. My settlement figure was £8500 +, however when I phoned a couple of months ago, it was £8000+.

    Apparently this is because interest accrues during the month, and the first time I'd phoned, it was just after a payment had been made, however the second time, it was not long before the next payment was due. Hence the second quote was for more money.

    Going on this, I'd recommend when when you cancel your PPI and have to re-take your loan, do it straight after a payment, as you'll probably save yourself some serious cash.

    I'm a bit narked that I've got to pay out an extra £500 than I could've done. (However I'm trying to balance that in my head against the £5.5k I'm saving through cancelling PPI!)

    £500 interest in a MONTH! Surely that isn't right? If you had continued to make monthly payments then the total amount would reduce. I think something is wrong here! Maybe I'm missing something but personally I'd be questionning that!
  • I have just received a response from loanmakers, they have asked me to complete a questionnaire with 26 questions basically yes or no answers, do i have to complete this even if i already sent a letter. It sais it enables them to help with my complaint. some of the questions are

    did i have life insurance before i got loan
    did i have accident/sickness policy before i got loan
    did the agent inform me of apr of the future commitment
    did the agent confirm if i was happy to proceed

    i then have to sign a declaration to authorise them to go to get info from my bank, lenders and any other 3rd parties.

    It all seems weird and i dont want them to be able to get my bank details

    Any help appreciated

    ps...this loan was paid off in 2006
