It seems everyone is trying to claim now even if they were sold a PPI legitimately. The banks and loan companies are now starting to fight back by contesting court action especially black horse.
With every decent genuine PPI mis-selling claim there seems to be 2 who are simply as they think it is a 'money for nothing' idea.It just seems to be spiralling out of control now everyone seems to be 'in on the act'.

    Nice first post.

Hi when you sent the letter requesting the list of charges did you use the template for reclaiming bank credit card/loan charges as i'm sure it says all default charges on it. Write another letter back to them stating that they had forgot to include any payment break plan charge's and could you please have a list of those too. Remember be nice as you don't want to upset them until you are reclaiming against them.:D

Thanks for the information. I did use the templates, so i could try that. I just phoned them (call me brave, lol) and they were very pleasant and said that the amount they have offered is 12 months worth, and that the total amount I have paid is £311.45, so been offered around 1/2.
I am guessing that because they can not prove it, hench they offered my what they have, that if i do take them to court I got a very good case. But to do this, i will need a break down of each monthly charge, do work out intreset for the claim. I am 1/2 tempted to take the money, but because they have not agreed to give back my charges I am a little bit bitter, lol

    Whats your thoughts?
  • Also they never charged me the 10er originally when i ask for the request of charges, shall i add another 10er to this letter in case?
  • how do i get in touch with the financial leasing authority?
  • i need help claiming back some ppi, i have all the documents but the FSO is saying they cannot help as they were not part of the FSA, yet their letters clearly state that they were.
    please help

could it not be everyone has just realised thet were mis-sold. like myself my oh was told by black horse no ppi no loan. we were sold ppi when i have numerous medical conditions, i am disabled and unemployment going under numerous medical tests at the time. i was 100% mis-sold the policy and black horse are saying we were not. so it is with fos.

also, not sure where the 'money for nothing' comes from - to make a reclaim you have to have paid the premiums + interest in the first place - ppi is the lowest payer out in percentage terms of ANY type of insurance policy - in otherwords for a large majority of policy holders they are worthless

if it is an 'independant lender' then they only came under the jurisdiction of the FOS on 15th January 2005, so if your loan came before then they wouldn't do - your recourse is to the County Courts (the lender has to tell you about taking your complaint to the FOS, it's the loan date that's crucial)

There is no doubt the odd person who would jump on the band wagon, but have you not read the posts??? Everyone on here has been genuinely ripped off by banks and yes, everyone should make a stand. The power needs to come back to the people to decide what is best for their finances and not the bank who see people in need as easy profit.

i agree i personally feel alot of people hadnt realised they could infact make a claim i only saw it by chance checked my policy single premium but what i hadnt realised was i would be paying for the life of the loan so it was obvious when i took out the loan i did not fully understand its contents
some people are happy to have a rebate some want to have it all and 8%
i just think its a matter of how far they want to go may be they think if they dont accept a rebate they wont get another offer but that is individual choice and we should respect there decisions i agree with lisaw people are being genuinely ripped off and its about time we stick to our guns they have got away with it for a long time and still are!!!!

I am personally going court with black horse but the no win no fee merchants have created a huge backlog by telling everyone who has had a PPI to claim to see if they get anything.
Due to the huge deficits companies like black horse face due to the amount of claimants, they have now decided to fight the majority of cases in court.
Companies like those do not care about when people say 'oh i am going to the media' and stuff like that but simply decide to call the customers bluff over court action.
If the templates do not work then the no win no fee sharks are the only way to go in case you lose court action and are faced with an hefty bill.
