    unfortunately that isn't the case - if you are the claimant you may still be liaible for costs if you lose and the claim is not within the small claims court !!

    Also, Black Horse like HBOS will deny every claim so the court route if you don't use the FOS is the only way of getting any money back - it's their policy

    i think a lot of companies think the customers will try there luck fob them off a couple of times and hope they will go away just by threatening them with court action or the FOS might work but i think you have to be prepared to go all the way either via the FOS or court route send the companies a copy of the complaint form for the FOS or court and show them you are not going to be fobbed off... and then be prepared for a long wait but hopefully it will be worth it in the end

    Ive got exactly the same problem, now 3 weeks. Going to send another by special delivery this time if nothing shows tomorow.
    Actually decided to ring them this afternoon, they have recieved my 2nd letter and booked it in on the 22nd of jan which took them a while. Royal mail still say its undelivered even when I told them they'd recieved it they did not believe me. Need to claim my 70p back now for the fact they ripped off the rcd del label. Only sure fire way of knowing they recieve it and when seems to be special delivery as they have to sign for it then and you will have dated proof.

    the small claims court is limited to £5000, if your claim is above that you complete what is known as an Allocation Questionaire whereby you state which court track you believe your claim should go down - here you can request your claim is allocated to the Small Claims regardless of value - I've had a claim for £12k allocated to the Small Claims track - that way the claimant isn't liaible for costs if they lose, but each judge makes up thier own mind as to which track they will allocate a claim to
  • mortgage group have replied saying i don't have any grounds for a refund due to the fact i signed an agreement.:mad: but they are looking into my complaint and will be in touch with a final decision in 4 - 8 wks :rolleyes:

    i never actually made a complaint i just asked for a refund :rotfl:
    i have sent 2nd letter stating that yes i did sign i am not disputing that i signed the agreement but i have repaid the associated loan 2 1/2 yrs prior to the end date of the policy and therefore it is no longer of use and request a refund of premiums paid ( single premium payment £3888) and any interest i am owed. so heres hoping :T

    Hi all,

    Received a email from First Plus today regarding my claim as planned. It basically said that they were still looking into my complaint, but would have a response no later than this Friday. (1st Feb) They also appologised for me not receiving the letter that they claimed to have sent. :rolleyes: Attached to the email was a copy of the said letter. It was vertually identical to the very first one I received way back when I first complained!!!
    I cant believe that they are still sending out basic 'fob off' letters when it has reached this stage!!!:mad: Anyway, i'll give them until Friday and wait and see what they say. If they request extra time again, there is no way i'll agree to it, I will just send forms off to FOS regardless.

    many thanks for your expert advice it always very good - i think ive got straight in my head now - if you get no result after your second letter and your claim refers to a period prior to 2005 and if its under £5000 you can go through the small claims court - if its over £5000 you complete a Allocation Quiestionairre and hope the judge agrees and allocates it to the Small Claims track - failing all this if you persue the court route you could be laible for costs if you lose
