I have a LLoyds loan taken out in April 2004, it was referred to a debt collection agency in 2007 and the current balance is now down to roughly £400. If PPI reclaimed and exceeds this amount will the loan be cleared with the debt company and the difference sent to me?
Would it be worth finding the £400 to CLEAR the debt and any monies due to come directly to me?
ANY advice would be HUGELY appreciated
AND....should I clear it before I get any letters off and start the reclaim process?0 -
Have now received my PPI back from HSBC regarding credit card. Only trouble is they have refunded it to my card that I no longer have and they will not send me a new one becasue it was me that cut it up and no longer use it so my card is £350.00 in credit and I can not get to that money.
Phone HSBC and ask to do a £350 balance transfer from another card. It shouldn't cost you anything as I am guessing your HSBC card does not have any special BT interest rate so you will be charged their standard interest on the amount you owe them. 16% of zero is zero! If you don't have another card see if they will do a transfer into your bank account or get a new card and transfer £350 from that to your HSBC one and then spend the £350 credit on the new card.Debt in June-03 - £24,000
Debt in June-06 - £8,500 (all on 0% cards)
Debt in Jan-08 - £4,000 (all on 0% card)
Savings greater than debt!
Officially debt free!!! :j0 -
Hi,
I am about to start a claim via MCOL against Blackhorse. I took out a loan with them in Aug 2001 then extended the loan in July 2002, they were classed as 2 seperate loans. On both occasions I was told that I had to have ppi in order to be approved. My question is, do I have to make 2 seperate claims or can I do one claim for both. Also the first loan falls out of the 6 year limit, does this make a difference?
Any help would be appreciated.0 -
Hi,
The loan i had n 98 and refinanced in 99 should have hada 4 year rebate on the PPI. LTSB have confirmed that they have no evidence of a refund, however, are not prepared to give me any money back. Is this legal???

Hi, if you no longer want the credit card account, just tell them that you want to close it. If it is in credit, then they will simply just send you a cheque for that amount. This happened to me with Intelligent Finance. I had a credit card with them a few years ago and settled it by paying off the balance with a loan.(LOAN HAD PPI!!! LOL):rotfl: Because i'd made a regular direct debit payment in the same month that I paid it off, I overpaid into the account. They gave me the option of either transfering it into our mortgage account or receiving a cheque for the overpaid amount.
If it is your money, they cant stop you getting to it!!!0 -

Hi guys, Have just written this letter to send to Egg and would appreciate advice as to if it needs to be reworded and also if I should mention about going to court or FOS. Not sure!!!
Dear Sir or Madam,
Re: Egg Card account number:
And Egg Money Card account number:
While looking through the data which you have recently sent to me, I have notice that there are payments added to the accounts which are called; Card Protect and Credit Card repayment protector. These payments I believe are commonly known as Payment Protection Policies (PPI).
I was not informed that you had sold me this policy and neither did I at any time request it. As you had charged me for this insurance I believe it to have been mis-sold to me.
I have checked my signed credit agreements and there is no mention of PPI at all, if there had been I would have questioned it and would not have accepted it as it was unnecessary in my circumstance as I will explain later.
I believe you have not treated me fairly for the following reasons;
· The PPI was added to my card accounts without my knowledge.
· I understand that under such insurance I would not have been covered anyway due to pre-existing conditions which I had suffered from and continue to suffer from. I was never asked or consulted about anything that would have prevented me using this policy and nor did I ever receive any documentation about this policy.
· You knew that I worked for the NHS and as such have an excellent sickness pay arrangement that would have covered my payments anyway, but you still took payments for this policy.
Your responsibilities
I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law.
I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise.
Your concealment of the true nature of the PPI payments has prevented me from asserting my right until now.
What I require
I calculate that you have taken £716.91 in payments from the Egg Card plus £184.45 (8% statutory interest, the amount a court would award) Total - £900.96.
Egg Money Card, £122.26 plus £29.04 ( 8% statutory interest, the amount a court would award). Total £151.30.
Total amount owed to me = £1052.26
My targets to resolve this matter
I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you will prefer to do this than merely respond with standard letters and leaflets.
I will give you 14 days to reply to me accepting, unconditionally, my request in principle and letting me know a date by which I will receive payment.
If you dispute that I am entitled to a refund of these payments, I request that you forward within the above mentioned time scale, a copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions. These are requested under CPR Pre-Action Protocol 4.6(c), and failure to provide them will be brought to the attention of the court, should it be necessary to commence a county court action.
If you do not respond, or you do not respond positively, within this time period, I shall send you a letter before action giving you a further 14 days in which to reflect. I believe that these targets are more than sufficient for a large company such as yours with dedicated staff and departments.
After that, there will be no further communication from me and I shall issue a claim at the expiry of the second deadline.
Yours faithfully,
Thanks in advance.0 -
