  • I'm currently battling First Plus on mis-selling as both my husband and I had good sickness/redundancy/life cover packages with our Local Government employers. The 1st letter from them basically said 'no chance' so I asked them for a copy of my telephone call. They have sent me copies of 'all available recordings' but my initial call with them isn't there! Not sure what to do now. Any advice anyone???
  • I took a loan from First Plus and prior to the paperwork came out received a call to sell me insurance which I said I did not require. I was told I would get full refund in 5yrs and as that coincided with our son's 21st agreed.
    We later fell on hard times and asked to cancel the insurance to save on repayments to be told it would only save me £1.60 per month. Then due to being unable to keep the full payment up and no help even when asked for I received repossession notice which I defended at court.
    One of the other things that came out the addition of the single payment insurance also put us into negative equity which means we can't go elsewhere to re-mortgage.

    SO WATCH OUT FIRST PLUS ARE WILL TRICK YOU WITH CLEVER WORDS.
  • I am not really sure if this is another fob off or if they are in fact correct or not, They have offered me a partial settlement pending cancel but are the sums quoted final or do admin fees etc come off.

    I still want to take this all the way as they ARE due me approx £3200

    I have been trying to get a copy of my loan policy so i can see how much ppi I actually paid. I first wrote to the RBS in Edinburgh and asked for a copy. They are also the insurance company. They wrote back after about a month and said they need £6 from me and the will sent me my bank statements. That is silly cause I already have my bank statements and it is not what I asked for.
    When i was going home from work on a Thursday night, I passed my branch of RBS and I went inside and simply asked for copies of the policy and a breakdown of the costs of the loan and PPI. They took some details from me and today, 9 days later I have the copies I was looking for and didn't pay a penny. So please, dont wastes your time and money by writing to the banks, just go into your branch and ask!

    Quick question.Sorry if its been answered elsewhere. Should I send the first letter to the manager of the branch I dealt with or somebody at head office?

    Hi, just a quick point - when asking for copies of the Terms & conditions you need to ask for the ones that were in place at the time you took out your loan, banks / lenders have a nasty habit of changing their terms over time to cover up loopholes etc !!!

    Send it to the complaints department of their HQ, that's where the branch will send it to anyway
  • I recently sent Martin’ pre-ordained PPI template letter to Tesco Personal Finance as regards a current loan taken out in 2005 for £25000 @ 6.5% for 7yrs.The loan a agreement stipulated £373.11/mth for borrowed amount and a whooping £67.23/mth for ‘PPI’. The letter was solely on grounds of miss-sale by sales personel but with a little addendum ‘that I have been paying for insurance that at best is not applicable to my circumstances and at worst grossly inflated for intended purpose’.
    Within 4 working days I got back a carefully worded reply which firstly apologised that I felt I was mis-sold to. Then swiftly proceeded to ‘clarify their position’ that the decision to opt for PPI is solely mine. The unscrupulous sale tactic that influenced that decision is the discord at hand here amongst other issues.
    I am seek to reclaim the PPI payments (27mths to date) + my duely court imposed interest of 8% in its entirety based on these points. Firstly because of their tactics towards customers where information is not clearly rendered especially when a preferred outcome and only that is acceptable when selling to the general public. Secondly where the cost of product PPI is grossly and blatantly inflated in comparison to the industry for same product.

    Hi There, you need to go back to them with an arguement based upon the law - if you feel you were mis represented to then this is called Negligent Misprespresentation under the 1967 Misrepresentation Act - under case law the onus is upon them to demonstrate they didn't mis represent to you. If you're not happy with their response write back on that basis, if you still get a negative you can take your complaint to the Financial Ombudsman.

  • Hi Guys

    received 2 x final responses in the post yesterday saying sorry but your getting nothing.
    First one was from barclaycard who say their policy schedule was sent and it was up to me to make an informed decion. Is this correct and what can i do now, when i took this credit card i worked for a company who payed full sick pay and death in service benifit at 4 x times my salary. Its about £3000 plus intrest they owe me.


    Second one was from Monument, more or less the same as above accept they can not find the phone conversation in their archived data, but have offered one years payments back as a good will gesture. should i just proceed to send the letters to the FOS or county court. do i now ask them for a total amount that was paid to them.

    any advice would be appreciated
