    Have just had another phonecall from LTSB with regards to my 3rd letter threatening court action.
    After speaing with the complaint handler and getting nowhere, i ased to spea to his manager. His response was ( my 3rd final response ) they were not upholding my complaint.

    After 30 minutes of getting his manager to see sense that had it been optional, no way would i have got myself into another 5k of debt for something i felt i wouldnt need, she has agreed to re-review with him tomorrow and call me bac with a 4th final response!!

    Lets hope its a positive one as i fully intend to tae this to court if not.

    Am a little bit confused about my situation.
    I came across the ppi section in this site and thought that I would call my Halifax bank to make sure that I don’t have any ppi on the loan I took out in September 2006. I called Halifax up today and found out that I have ppi on my loan, so I put in a complaint, as I was unaware that I was given ppi. At the time of taking out the loan all I wanted was the money as I was having financial difficulties and was not made aware that I would be taking out payment protection insurance. The advisor I spoke to today told me that I had signed the agreement which had all the information regarding the ppi however at the time I was told that I would be paying a total amount of £8033.76 including an interest of 21.3% but no information about ppi. I also tryd to cancel the ppi today but the advisor told me that i would have to take another loan to pay this loan off which would be without the ppi but may have a higher apr and if i am not accepted for the new loan then i would need to keep paying off my current loan with the ppi. All this time I have been paying for my loan and not knowing that I was also paying for ppi. Would this be classed as mis-selling? Could I make a claim for this? Please could anyone help me out and give me advice on this…would really appreciate all the help and advice. Thank you. Game-a

  • fUNNY YOU SHOULD ASK,GOT MY HUSBAND TO RING THEM A FEW HOURS AGO,SAID THEY HAD GOT THE LETTERS AND WOULD BE IN TOUCH WITHIN THE NEXT COUPLE OF WEEKS! PROBABLY JUST HOPED WE'D GO AWAY IF THEY DIDNT REPLY TO THE LETTERS.MY HUSBAND HAS BEEN PAYING PPI ON HIS CREDIT CARD WITH NATWEST SINCE 1991,AND HAS ALWAYS BEEN SELF EMPLOYED.HE CANT EVEN REMEMBER ASKING FOR THE INSURANCE,IT BEING OFFERED,AND HAS NO IDEA IF IT WOULD EVEN PAY OUT IF HE NEEDED IT.WE SHALL SEE WHEN WE READ THE TERMS AND CONDITIONS FROM WHEN HE TOOK IT OUT.WILL LET YOU KNOW WHAT HAPPENS.THANKS FOR ADVICE

    if they haven't responded within 8 weeks write and tell them they are in breach of their statutory duty to respond and if they don't you'll take your complaint and their breach to the Financial Ombudsman

    Hi you've definately got a case for mis selling, rather than ring you really should put everything in writing - look at the template letters on this site. If you have been mis sold a policy the Halifax are quite at liberty to request you take out another loan - however, this is the important bit - the Financial Services Authority have stated you should not be financial disadvantaged by the mis selling - ie they shouldn't deny you a 2nd loan and it should be equal to if not better than them apr of the loan you're on. If I were you I'd put in writing the conversation you had today and ask for a transcript because you should not have been told it is at a high apr - and you could report the Halifax to the Financial Ombudsman on that point alone

    Hi there, if I were you instead of going for the mis selling angle I'd go for the 'no refund / partial refund terms' on early resettlement - basically the Financial Services Authority have stated these terms to be unfair under the Unfair Consumer Contract Terms Regulations 1999 - please look at my previous posts for a link to the relevant FSA document - say you want your money back - copy the document to them - tell them you're prepared to go to court and given the fsa ruling you're not doubt as to your success.

    hi there, I've posted Martin / Wendy regarding this issue - the problem with the template letters is that they are not differentiating the law and the difference between mis selling and the 'no refund / partial refund' on early settlement - the first is misrepresentation under the 1967 Misrepresentation Act the 2nd is far simpler to claim back as the FSA have said to be unfair under the Unfair Consumer Contract Terms Regulation 1999 - see previous posts and list to the FSA ruling - write back copying that document and state you're prepared to go to court and given the FSA ruling you've no doubt that you'll win

    if you've made a claim on your policy you won't be able to make a claim for mis selling
  • Hi guys,

    I have been reading through this thread and was wondering if anyone has come up against the following arguement for not being able to reclaim PPI.

    I had signed up for PPI not realising that since i have diabetes i would not be covered for any sickness, etc, stemming from it. :o

    Here is the response i have had from MINT and MBNA.
    Basically that since the PPI was applied for on application and that the T&Cs were sent out, with a 30 day no obligation guarantee, it was up to me to read through them and ensure i was eligible to cover and that the policy met my requirements. :o

    Both MBNA and MINT, previously RBS Advanta, have given me this response in relation to my PPI claim on their credit cards.

    Furthermore MBNA have said that they have exhausted their internal complaints procedure, after my first letter, and this is their final response.

    Any help would be greatly sought after and appreciated.
