    I followed the instructions that came with the template letters download which said that if I din't know how much they had taken the to request it.

    i am a bit worried about the loan company forcing me to accept that any money they pay back to me goes straight to my loan account rather than being paid out to me. What can i do about this - can i force them to pay me rather than credit the loan?
    I notice that you suggest a complaint to the Ombudsman - is there something in their rules that support this argument?

  • I have just received my final response letter from Capital One saying they won`t be refunding PPI on my credit card from 2004 and i should now go to the FOS.
    Is this the correct next step? Or can i threaten them with court action first, and then still use the FOS as a last resort? I just want a quick outcome to all this now..... would it be quicker to use a proper reclaiming firm? Anyone recommend any? As i have 4 other companies i`m trying to deal with and all have ignored me so far :mad:

  • Hi, good news this morning, with reference to PPI mis-selling LTSB, as a 'gesture of good will', are prepared to offer me a refund of £1600 plus interest accrued, but they want to credit the £1600 to my loan account. This means the monthly instalment on my loan will remain the same, but the balance and term of the loan will be reduced.

    I would prefer the £1600 plus interest be paid into my current LTSB current account instead of the loan account. Can anyone advise me if I am within my rights to ask for this ?

    Thanks for this...i too have had several "final response" letters and like you i need to be steered in the right direction as to what to do next! I already have two complaints with the FOS. Surely there's someone out there that can help us with the next stage (even if its a template letter to the company telling them what we want before we complain to the FOS.)

    Well it's up to you, threaten court or go to the FOS. Only you can decide really. FWIW I would go the court route, but that is purely personal opinion.

  • I have contacted the brokers who were Central Capital but now Central Trust and they have sent me a snotty letter saying

    "Please don't think I am being belligerent but your complaint does seem somewhat broad. The redeeming of your loan early and the canceling of the insurance does not in itself constitute a mis-sale of PPI.":p:p:p

    They charged me £11000 insurance for 1 year. :mad:
    What should i do now and is there a template letter on here to help me through the next step?

    Have just had a final response to my second letter and they are not budging. Cant go to FOS as not in last 6 years.... any ideas guys????

    SOMEONE HELP ME PLEASE!!!!!!!!!!

    mis-selling is only one way to challenge the lenders over this issue. There are more simple ways of challenging with relatively no time limit.
    I will advise.
    I am a former Broker, former IFA and former compliance officer, for my sins.

    However, I have since seen the light.

    See post 1389 for an example letter to threaten court action. Odds are they won't want to go to court and will fold.
