You need to start Court Proceedings or at least threaten them - the relevant law is the Misrepresentation Act 1967 - you have been Negligently Misrepresented to and as such the onus is upon them to prove otherwise - this legislation is only 3 pages long and can be down loaded from the internet - fill in a N1 claim form and send a copy to them - tell them you'll issue the form in the New Year if you don't get satisfaction.Thanks Peter. They said that their reply was a final response, I know that's part of the dance so to speak, but in your experience do they normally play ball. Haven't seen a lot reported on the success front apart from fivebellies. Was wondering if I would have to go the FOS route.0 -
Hi there, they HAVE to tell you to go to the FOS it's one of the regulatory rules, fill in the FOS complaint form and send a copy to them 'out of courtesy' bet you within 7 days they'll back down.After my success with HSBC regarding the PPI on my loan I have gone after them for PPI on my credit card exactly the same circumstances as for my loan which were my working hours of 10 per week, meaning I did not qualify for PPI, they paid mwe back for my loan but will not budge on the Credit Card, I don't understand why really surely if they admit fault with one it is the same for the other, they have even told me to go to the FO so they must be confident, any help would be good.

Cheers for the advice it's picked me up again... do i need to send a second letter to them now or i can just call them up to let them know I will now be taking court action is that a little ahead of myself...thanks

Anyone had any luck with Natwest?
i am still waiting to hear from them - they keep fobbing me off with letters saying they are undecided and will be in touch within 2 weeks which has happened twice now! Their 2nd 2 weeks will be up on 19th!Friends are angels who lift us to our feet when our wings have trouble remembering how to fly.0 -

Hi can anybody help me here, I have had about 10 credit cards over the last 12 years to which I have paid payment protection for the duration.
Please excuse me if this has been covered before but: I have been self employed for the last 20 years and have never claimed on the any of the insurance policys connected to my credit cards.But after reading the great posts on here I have calculated the ppi to be about £1200 over the years.
I have used quicken for the last 12 years and just had a look at it.For me to recover anything like this amount would make me a very happy man indeed.My biggest payments have been to Barclaycard and MBNA bank.
Can somebody direct me in the right direction.

Hi there, you can only reclaim going back 6 years under the Statute of Limitations, the problem you're going to have is they'll want to know why you never complained / cancelled before. Therefore, use the standard letter on here but make if very clear why you've left it so long before complaining - also, you won't be able to go to the Financial Ombudsman as you're time barred but you can make a claim through the County Court, but you have to make it clears it's for the last 6 years only as the Court will not look at anything previousHi can anybody help me here, I have had about 10 credit cards over the last 12 years to which I have paid payment protection for the duration.
