  • Hi,

After reading about PPI claiming I suggested to my finacee that she gives it a go on her Debenhams store card that she has PPI on provided by GE Money(ppi on account since 20/11/2002). Having sent the "template" letter (the option that they've already been fined etc etc) she has had a reply that amongst other things reads......claims can only be made on policies taken out since 14/01/2005.........the rest is basically waffle form what I can gather.
Anybody had any dealings with GE Money along these lines?? Any advice/ideas much appreciated.

    Thanks
    Neil

What they mean is that they came under the Jurisdiction of the Financial Services Authority on 14/01/05 so you can't take you complaint to the Financial Ombudsman - what you can do through is take the claim to the county courts - draw up the claim and send it to them as a 'Courtesy'

Hi they will deny your claim by saying your husband is covered by the policy even though self employed - what you need to do is ask for a copy of the Terms & Conditions when the policy was taken out - what it will say is that to claim you have to be claiming job seekers allowance / company has ceased to trade - challenge this on the basis of different for employed / self employed persons paying the same premiums. Also, if they say in their letter he was fully covered and he isn't tell them you'll use that letter as evidence of further Negligent Misrepresenation and it will be presented in a court of law. - Good Luck

    Hi all,
Have had the no, your ppi was not missold letter from Egg today, and they say that is their final decision.. Am I right in sending the second letter now.. The ppi was sold to me as a single premium policy without anything being said by the salesman, not the cost of it, anything, he implied I needed it to get the loan, the loan of £10000 was paid off 2 years early and they received over £13000 for it.
    What should I do now.
    Many thanks
When did you take out the loan and pay off the policy - you could get more money back doing it a different / much easier way !!

also, not sure if anyone is aware of this or if its just ltsb, but of your account goes to the debt recovery team, then you ppi is void anyway, therefore an automatic refund should happen and doesnt.

Hi there, no big mystery but rather than going for the mis selling angle, the Financial Services Authority have stated no refund or partial refund terms to be unfair under the Unfair Consumer Contract Terms Regulations 1999 and as such you stand to get your money back easier and they are more likely to pay the 8% Statutory Interest as it's clear you've been unlawfully deprived of mony. How much were you rebated (or did you have to pay out) when you settled you loan early and I'll work out the 8% interest for you. Regards
